BOARD OF APPEALS
NANTUCKET, MA 02554
At a public hearing on Friday, April 26, 1991, at 1:00 p.m.
in the Town and County Building, Nantucket, on the Application
(020 -91) of CHARLES KESSER and THEO HICKEN, dba the INDIA HOUSE,
having an address at Box 576, Nantucket, MA 02554, the Nantucket
Zoning Board of Appeals made the following DECISION:
1. Applicants seek a Special Permit under zoning Bylaw
Sections 139 -33A and 139 -22H to alter and extend their combined
guest house and restaurant use of the premises by adding an
Employer Dormitory on the third floor. An interior stairway to the
third -floor space will be constructed to provide the required
alternate means of egress. Relief from the corresponding off -
street parking requirement is sought by Special Permit under
Section 139 -18G.
2. The premises are at 37 India Street, Assessor's Parcel
42.3.4 -128, Plan Book 20, Page 12, zoned Residential -Old Historic.
3. The Board previously granted the requisite relief on
January 31, 1989 (See Board of Appeals decision 117 -88). Applicant
was unable to agree with the Historic District Commission as to
design and appearance of exterior stairway and after many months
of meetings, applicants decided to provide access via interior
stairways and that is the reason they are back before this Board.
4. Our findings are based upon the application papers,
presentation of applicants attorney and upon the facts and
findings in our previous decision which are incorporated 'herein by

The original decision on January 31,1989 (copy attached) anticipated an exterior stairway
for access; applicant has spent months with HDC trying to find a satisfactory deslgii.,..
and that is the reason the original decision of the Board was not implemented. Owners
finally have decided on an interior stairway however, over a year has elapsed and they
need a new permit from the Board \q
