At a Public Hearing of the Board of Appeals held on February
15, 1991, at 1:00 P.M., in the Town and County Building, Broad
Street, Nantucket, Massachusetts, on the Application (No. 015-
91) of Willie House, of 9 Trotters Lane, Nantucket, Mass. 02554,
the Board made the following DECISION:
1. Applicant seeks relief by Special Permit under Section 139 -
33A of the Zoning Bylaw to alter a pre- existing structure said to
be nonconforming as to rear yard setback. The existing structure
is 1.78+ feet from the rear lot line; ten feet (101) is required
in the district. The alteration proposes to change the use of
the structure from an accessory use, stable, to a secondary
dwelling unit, by adding a second story to a portion of the
existing structure. The alteration will not increase the
nonconformity as to setback, nor will it increase the existing
ground cover.
2. Our decision is based upon the application and documents
filed therewith, the testimony and evidence presented at the
hearing, and a favorable recommendation from the Planning Board.
There were no letters or statements in support or opposition from
any abutter.
3. The main section of the stable was constructed prior to the
enactment of zoning on Nantucket, with a small addition
constructed in 1975 -6, pursuant to a validly issued Building
Permit. There is more than twelve feet (121) between the stable
and the principal dwelling on the lot, and the lot conforms to
the dimensional requirements for the district. Parking can be
provided on site as required by Section 139 -18D of the Bylaw.
4. The Board finds that the proposed addition to and use of the
structure as a second dwelling will not be substantially more
detrimental to the neighborhood than the existing nonconforming
structure, and the nonconforming distance at the rear line of the
lot will not be made more nonconforming by the addition.
5. By unanimous vote, the Board voted to GRANT the Special
Permit, as requested, subject to the following condition:
A) the building shall be constructed in substantial
conformity with the plans appended hereto as Exhibit A.

ADDENDUM%A
Applicant wishes to alter a pre- existing non - conforming horse barn
that is sited 2+ feet from the rear lot line, by adding a second
floor to a portion of the structure to create a secondary dwelling
unit. It will conform to the 12 foot requirement for the siting of
a secondary dwelling and the footprint will not change nor will
any renovation of the structure change the non - conforming setback
distance. Because the structure pre -dates 1972 zoning Applicant is
seeking a Special Permit under Section 139 -33A.
