Applicants are seeking relief by Special Permit under Section 139 -33A of the Zoning Bylaw to allow relocation of an accessory building, a shed, which is nonconforming as to side /rear setback and which is on a lot which is nonconforming, having four (4) dwellings on the lot, and one of those dwellings is nonconforming as to front and side setbacks; another is nonconforming as to side setback. 2. Our decision is based upon the application and documents filed therewith, the testimony and evidence presented at the hearing, and a favorable recommendation from the Planning Board. There were no letters or statements in support or opposition from any abutter. 3. According to the evidence, all structures on the lot predate the enactment of zoning, and the proposed plans will relocate the shed from its present position within the side /rear setback to a location fully complying with present dimensional requirements of zoning. No changes will be made to any other structure on the lot. 4. The Applicants are proposing the relocation of the shed at the request of the Conservation Commission, as the shed presently is sited within a buffer zone, and the Historic District Commission wants the shed preserved due to its significance; some minor renovation of the shed is planned as part of the relocation. 5. By unanimous vote, the Board voted to GRANT the Special Permit as requested by the Applicants to relocate the shed substantially in compliance with he plans submitted with the application.
