NANTUCKET ZONING BOARD OF APPEALS 2 Fairgrounds Road Nantucket, Massachusetts 02554 Assessor's Map 66, Parcel 390 5 Appleton Road Residential-10 (R -10) DECISION: Certificate of Title 22449 Land Court Plan 13554 -D Lot 19 1 • At a public hearing of the Nantucket Zoning Board of Appeals held on Thursday, May 11, 2016 at 11:00 A.M., in the Conference Room, at 4 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following Decision on the application of JOHN T. SULLIVAN AND MARIE T. SULLIVAN, 5 Appleton Road, Nantucket, Massachusetts 02554, File No. 11 -16: 2• Applicant is seeking relief by Special Permit pursuant to Zoning By -law Section 139 - 16.0 by reducing the side yard setback from ten (10) to five (5) feet in order to validate the siting of the existing main dwelling and to site a proposed 400 square foot garage within the ten (10) foot northerly side yard setback. The Locus is situated at 5 Appleton Road, is shown on Assessor's Map 66 as Parcel 390, and as Lot 19 upon Land Court Plan 13554 -D. Evidence of owner's title is registered on Certificate of Title No. 22449 at the Nantucket County District of the Land Court. The site is zoned Residential 10 (R -10). 3. Our decision is based upon the application and accompanying materials, representations, and testimony received at our public hearing. There was no Planning Board recommendation on the basis that no matters of planning concern were presented. There was no opposition, written or oral, presented at the hearing. 4. As presented to the Board by the Applicant, relief by Special Permit is sought for a waiver from the intensity regulations in By -law Section 139 -16.A for both the As -Built primary dwelling and for the proposed expanded garage structure. Pursuant to Section 139- 16.C(1) regarding setback waivers: The Board of Appeals may grant a special permit to reduce the 10 foot side yard setback and the 10 foot side and rear yard setback in R -10 [... J to 5 feet. 5. The house was constructed in 1987 at which time the north elevation was sited fifteen (15f) feet from the northerly side yard lot line. Applicants bought the property in 2006, prior to the 2012 zoning change (Annual Town Meeting; March 31, 2012; Article 44 changed the locus from RC -2 to R -10). This change reflects the primarily residential nature of the west side of Appleton Road, whereas the east side is zoned RC -2, R -5, and R -20. In January, 2013, applicants filed a Building Permit (No. 319 -13) to build a 270± SF addition. The northwesterly comer of the house, as so altered, is shown on a 2014 As -Built to be 7.4 feet from the northerly side yard 2 lot line as a result of this alteration. The Building Permit was on December 22, 2014. Therefore, relief is sought to validate the granted son of the main dwelling and for the siting of the proposed new construction of the garage in the southeast corner of the lot, to be sited as close as five (5) feet from the northerly lot line. Applicant states that there is no other suitable place to install the proposed 400 square foot garage. The relief sought pertains to setbacks from the northerly side yard lot line for both the primary dwelling and the proposed garage, as shown on plan entitled, "As -Built Plot Plan with Proposed Garage in Nantucket, Massachusetts ", dated February 10, 2016 and prepared by Earle & Sullvan, Inc., attached herewith as "Exhibit A ". 6. Therefore, after a discussion with the Applicant, the Board determined that a Special Permit may be granted based upon the finding that the Applicant met the threshold criteria for the relief sought pursuant to Nantucket Zoning Bylaw Section t met .C(1). The relief applies specifically to validating the siting of the primary dwelling shown on the above - referenced plan to be as close as 7.4 feet from the northerly side yard lot line and the proposed garage to be sited as close as five (5) feet from the northerly side yard lot line. The Board finther found that such a grant of relief would be consistent with similar relief granted by this Board to several properties located within equally thickly settled R -10 zoning districts and would be in harmony with the general purpose and intent of the Zoning By -law. The relief shall be restricted such that no further construction may take place within the required ten (10) foot northerly side yard setback area without further relief from this Board. 7. Accordingly, by a UNANIMOUS vote of the sitting Board, the Zoning Board of Appeals GRANTED the requested relief by SPECIAL PERMIT pursuant to Nantucket By -law Section 139- 16.C(1) to validate the northerly side yard setback intrusion of the primary dwelling and to approve the siting of a proposed 400 square foot garage within the ten (10) foot northerly side yard setback the, as shown on "Exhibit A ". Relief is conditioned upon the following: a. The proposed garage shall be constructed in substantial conformity with the above - referenced plan; and b. There will be no further alteration or construction within the side yard setback area of ten (10) feet without further relief from the Zoning Board of Appeals.
