Enclosed is the Decision of the BOARD OF APPEALS which has
this day been filed in the office of the Nantucket Town
Clerk.
An Appeal from this Decision may be taken pursuant to
Section 17 of Chapter 40A, Massachusetts General Laws.
Any action appealing the Decision must be brought by
filing an complaint in court within TWENTY (20) days after
this day's date. Notice of the action with a copy of the
complaint and certified copy of the Decision must be given
to the Town Clerk so as to be received within such TWENTY

At a Public Hearing of the Zoning Board of Appeals held on
Friday, August 17, 1990 at 1:00 P.M. in the Town and County Building,
Nantucket, on the Application of SAM STARK (051 -90) the Zoning Board
of Appeals made the following Decision:
1. Applicant sought a Special Permit under Section 139 -16 of the
Zoning By -Law to reduce the required sideline setback requirement
from 10 feet to 5 feet on the northwest side of the lot. The
dwelling which is currently on the site, extends into the required
setback 0.93 feet, and the Special Permit is to validate the
siting of the building as it exists as evidenced by a site plan
dated April 11, 1988 (our Exhibit "A ").
2. The Applicant stated that the building encroaches upon the setback
due to the difference between the siting of the foundation wall,
which conforms to the required ten (10) foot setback, and the
wall of the structure, which overhangs the foundation wall,
encroaches.
3. Absent any opposition and with the favorable recommendation of the
Planning Board, our Board finds that the requested relief is in
harmony with the general purpose and intent of the By -Law and
grants the Special Permit to validate the siting of the building as
it exists subject to the following conditions:
A. the incursion be no more than one (1) foot into the required
setback;
B. there be no further incursion or enlargement of the existing
incursion.
