Decision:
The Board of Appeals, at a p_
May 4, 1990 at 1:00 P.M., at the Town and County Building,
Nantucket; made the following decision upon the application of
JEFFREY G. BROOKS and MILTON C. ROWLAND, TrUa,.ces of J.A.M. REALTY
TRUST, as Owners, and ELIZA13ETH B. SIBLEY and ROBERT J. LIDDLE,
as Contract Purchasers (29 -90):
1. This is an application for a special hermit under Nantucket
Zoning By -law Section 139-9.B(3) (a ) and ( b) ,o- use of the subject
premises for light manufacturing and fabrication and assembly of
component parts for off -site cons. use. lire subject
property (the "Locus ") is located at 15 TEASDALE CIRCLE (Assessor's
Parcel 69 -69) , Land Court Plan 1 43 " - -n , L- 7. as
RESIDENTIAL - COMMERCIAL -2.
2. The applicants propose to cc,. ruc _,ree buildings upon
the Locus, which is near vacant land. 'The revised proposed site
plan, attached hereto as Exhibit A, shows these buildings and the
proposed layout of parking spaces. Building A is to contain
approximately 1550 square feet of manufactrina space, and
approximately 250 square feet of retail s_ on principal
floor, plus approximately 650 square feet of storage space in the
attic. Building B is to contain approximately 1500 square feet
of manufacturing and storage on the main (and only) floor. There
is to be no retail space in Builri -nq B e e
casual retail sales by the occupant oL tsuildi;,g B, wi-cn no dedicated
retail area nor public invitation to retail purchasers). There
is to be no other floor area in or
area devoted to mechanical systems, not counted as "gross floor
area" under the By -law definition). Building C is to be a
two- story, single- family dwelling.
3. The uses proposed by a __cants consi__ of
cabinetmaking, woodworking, and toy manufacturing, and related
activities in Building A, and mane -F _'.:,rina of pasta and related
food products in Building B.
4. We have no difficulty in --ng, U „u do L-L iu, tnat the
proposed uses of the Locus for light manufacturing and fabrication
and assembly of component parts for off -site construction or use,
generally as described in Paragraph i'l ;je in harmony wizin
the general purpose and intent of the By -law, and will not violate
Section 139 -20, so long as the conditions set forth in this
decision are met.
5. The relief hereby granted is subject to the following
conditions:
a. Only one dwelling unit shall exist upon the Locus
until it is lawfully connected to a yui -ic
b. Said dwelling unit shall not be offered for nor
Osed for seasonal occupancy.
C. The applicants shall plant vegetative screening .11ong
the northerly (Hinsdale Road) boundary of the Locus, consistent
with the already, existing screening of adjacent lots.
d. The Locus shall not ha— d;. t dr 4 a: � to
Hinsdale Road.
e. Siting of the building- and _r'. °'ing ",as upon the
Locus shall be substantially in accordance with Exhibit A hereto,
subject to any minor_ changes requested and approved by the Historic
District commission.
f. The buildings, as constructed, shall substan--lally
conform to the description of floor area and number of floors, as
set forth in Paragraph 2. Gross floor area of commercial use,
including indoor or other covered storage areas, as defined in
the By -law, shall not exceed 4,000 square feet i.r total urless a
further special permit for a major cummer��_ de.,:lopment under
Section 139- 9 -B(4) shall have been issued by the Planning Board
as special permit granting authority.
g. Off- street parking and loading spaces shall be
provided in conformity with the By -law and approximately as shown
in Exhibit A.
h. No violation of By -law Section 139 -20 shall be made,
permitted or suffered to exist by t' ^.e e.r.s from time to time of
the Locus.
i. The commercial buildir�;s u.,.,_. -he lucus small be
used for the purposes described in Paragraph 3, or similar uses.
6. For the reasons hereinstated, and subject to the foregoing
conditions this Board grants a Special Permit under Section
139- 9.B(3) (a) and (b) as requested, by unanimous vote.
