Decision:
In the matter of the Application of KATHLLE_d ? ^ "
STEPHEN T. DUNCOMBE (028 -90) , at a meeting of the Board of Appeals
held at 1:00 P.M. on Friday, May 4, 1990, at the Town and County
Building, Nantucket, the Board made the following decision:
1. This is an application for a Special i =_ _:,,it under Nantuc: -_et
Zoning By -Law Section 139 -7.0 (Exception for Accessory Apartments) .
If granted, the applicants would be permitted to have a year -round
accessory apartment within their existing dwelling. The subject
property (the "Locus ") is situated at 4 COr "FTA LAr'r, (Ass(-.---- _-'s
Parcel 80 -61) , Plan File 4 -C, Lot 18, and ys coned Lil,411 Ei"
GENERAL -2.
2. Based upon the application and the ;n-�:- _-erials presented
at our public hearing, we find that the Locus consists of a
parcel containing about 61,440 square feet, containing an existing
dwelling. The applicants propose to utilize 619.5 square feet of
this dwelling, which we are told contains 2182.75 s_, re f,_et of
gross floor area, as a year -round accessory apartment, in compliance
with all requirements of the by -law, includira parking.
3. This Board finds that the proposed use as a year -round
accessory apartment is in harmony with th __:er, fpc__ _:nd
intent of the by -law, and that the proposed apartment appears to
comply with all standards established in Section 139- 7.C(2).
4. The relief granted hereby is upon the following
conditions:
(a) That all requirements set forth_n Sect; on 139-7-C(2)
be complied with.
(b) That, prior to the issuance of Certificate of
Occupancy for the accessory apartment, the owners of the Locus
execute the restriction and affidavit requi_ (2)(g).
5. For the reasons and
