Sherman, CVirma M BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 Decision: At a public hearing of the BOARD OF APPEALS on Friday, September 15, 1989, at 1:00 P.M. at the Town and County Building, Nantucket, on the Application (049 -89) of MARY C. HUMPHREY of 520 Ash Street, Winnetka, Illinois 60093, the Nantucket Zoning Board of Appeals made the following DECISION: 1. Applicant seeks a Special Permit under the Zoning Code Section 139 -33A to alter a pre - existing, non - conforming residential structure by constructing a one.and -a -half story addition to the rear of the building. The premises are located at 31 Union Street, Assessor's Map 42.3.2, Parcel 145 and shown on Plan Book 11, Page 47,in the Zoning District Residential - Old Historic. 2. Our findings are based on the application papers, a copy of the recorded plan of the premises and the elevation and floor plans for the proposed addition as submitted to the Board along with testimony and representations made at the public hearing. The plans for the addition are marked Exhibit A. 3. The improvements on the property have existed in their current configuration since the 1920s. The house was divided into two apartments at that time (one on each floor) and continues to be utilized as two dwelling units. The existing ground cover ratio for the structure on the property is 33.1 %. Permissible ground cover in this zone, given the lot size of 4,536 square feet, is 30 %. The 170 square foot addition will increase the ground cover ratio to 36.8 %. The existing structure is sited 2.15 feet from the northerly lot line. The proposed addition will extend the structure along the northerly line but will not make the nonconforming distance more nonconforming. 4. The addition is necessary to correct the unsafe design of the narrow and steep stair -ways in the structure. The floor plan submitted shows the addition of a bathroom on the first floor and a slight enlargement of the existing two bedrooms in addition to the reconfigured stairways and enlarged "mud room ". Second floor plans were submitted for informational purposes, but that layout is not incorporated into this decision. 5. No opposition was heard to the application. Given the need for stairs to the cellar and to the second floor that meet the safety standard of the current building codes and the small incremental increase in ground cover, we see no detriment to the neighborhood in connection with the applicant's proposed addition. We therefore find that the proposed addition will not be substantially more detrimental to the neighborhood than the existing non- confTipmity and in harmony with the general purpose and intent of the Zoning By -Law. 41 6. applicant construct the plans Accordingly, this Board by UNAMIMOUS vote grants to the the requested Special Permit under Section 139 -33A to the proposed addition in substantial conformity with submitted as Exhibit A. The lot has an area of 4,536 square feet, 464 square feet less than the required 5,000 square feet in the zone. Accordingly, only a 30% ground cover is permitted. The structures already on the lot cover 1,502 square feet for an existing ground cover ratio of 33.1 %. The addition to ground cover consists of 170 square feet thereby increasing the ground cover ratio to 36.8 %. Additionally, the existing dwelling is sited only 2.15 feet off the northerly lot line where a five foot setback is required. The proposed rear addition would extend the structure along the northerly line approximately 8 feet, but in such a way that the nonconforming distance is not made more nonconforming.
