This letter is written to confirm that Robert Sarvis, Trustee
of Nantucket Commons Trust hereby extends the period within which
the Board of Appeals must make and file its decision in
connection with the above captioned appeal to December 31, 1989.
Further, the applicant has negoiated a settlement with the
Building Inspector and Planning Board with regard to the subject
matter of the appeal and therefor the appeal is moot.
Accordingly, applicant requests permission to withdraw his
appeal, without prejudice.

your request for a Temporary Certificate of Occupancy (C.U.), fnx a
portion of Building 5, as provided for in Section 119.4 of CMR 780 and
by Chapter :139 -28C of the Code of Nantucket has been reviewed and for
the reasons set forth below is hereby DENIED.
Special Permit (6- 86) set forth the phasing criteria by which the
site improvements are to be constructed relative to the issuance of
Building Permits and C - O' s for the various buildings in the development
(sap, paragraphs 10 & 11 of Amendment 41).
As yota are aware, it has been my practice when an application for a
C.O. is submitted to x7eque5t the assistance of the professional staff of
the Planning Board to do site inspections and to give it's opinion ca to
the adequacy of the site i,Ymprovements . This information is used as an
element in ray evaluation as to the 'project's compliance with the Special.
Permit. Upon review of the letter from the Nantucket Planning Board
dated Julie 30, 1989 and my own. inspectionF, I � -.onGUr with and include X,Y
reference the opinion of the Planning Board that the project has not
completed the infrasti�-uclture requirements of the Special- Permit in Ync
with the phased release of bu ild:,i.ng C . G . ' s .
Furthermore, our records indicate that a. copy of the Town of
Nantucket Sewer. Entry Permit has not been. 51.1bmitted to this office For

copies of the approved Permits.
Based on the above I find that the request for ca C-0.
premature and not in compliance with the .Special Kermit (6 -86) and
hereby deny the issuance as per Chapter 139 -28 of the Code of Nantucket..
