An appeal from this decision may be taken pursuant to section 17 of Chapter 40A,�Massachusetts General Laws. Any action appealing the decision must be brought by filing complaint in court within twenty (20) days after this date. ELINOR HARRINGTON, for herself and JUDITH HARRINGTON, having an address at 44 Raymond Street, East Weymouth, MA 02189, the Nantucket zoning Board of Appeals made the following DECISION: 1. Applicants seek a Special Permit under zoning Bylaw Section 139 -7C to construct and provide an Accessory Apartment in their single - family dwelling within an existing single -story northerly wing. 2. The premises are located at 64 Prospect Street, Assessor's Parcel 55 -333, Lot 6 of Land Court Plan 13302 -E, zoned Residential -1. 3. Our findings are based upon the Application papers including a copy of HDC Certificate of Appropriateness No. 19,637 with attached set (our Exhibit "A") of drawings dated 3/20/89 and site plan dated 3/21/89, together with representations and testimony received at our hearing. 4. We find that the proposed Accessory Apartment is able to qualify for a Special Permit under Section 139 -7C. As shown on the site plan, the required two off - street parking spaces will be provided. The apartment will be installed without increase in coverage on this 6534 -SF lot. It can be constructed to meet all the requirements of Section 139 -7C and a covenant executed as specified in Subsection 139 -7C(g) to insure year -round occupancy. 5. As evidenced by the Certificate of Appropriateness, the Historic District Commission has approved Applicants' proposal from an esthetic viewpoint. The Planning Board's recommendation was favorable, and no opposition was heard. The relief sought is in harmony with the general purpose and intent of the zoning Bylaw, codified in Chapter 139. 6. Accordingly, by unanimous vote, this Board grants to Applicants the requested Special Permit under Section 139 -7C to install the Accessory Apartment in their dwelling, as proposed, in substantial conformity with Exhibit "A ".
