DECISION:
The BOARD OF APPEALS at an informal public hearing held on
Friday, July 28, 1989, at 3:00 p.m. at the Town and County
Building, Nantucket, made the following modification of the
SPECIAL PERMIT granted to Max N. Berry and Heidi L. Berry
(024 -89) whose address is 2716 Chesapeake Street, Washington,
D.C. 20008.
1. On May 8, 1989, the Board of Appeals granted to the
Applicants a Special Permit allowing the proposed alteration and
expansion of a pre- existing garage situated off Coffin Street in
substantial accordance with the plans prepared by Design
Associates and filed with the original Berry Special Permit
application;
2. A Special Permit was granted to the Applicants upon the
following conditions:
A. The garage building shall include no cooking or
eating facilities;
B. Occupancy of the garage building shall be limited
to overflow use by members of the Applicants' principal dwelling
household, guests, caretaking and housekeeping staff, and it
shall not be leased to others;
C. The Applicants shall construct the garage building
in substantial accordance with the Exhibit "A" plans with such
minor changes as may be required for approval by the Historic
Districts Commission; and
D. No second dwelling unit or secondary dwelling
shall be constructed on the premises;
3. On June 6, 1989, the Department of Environmental
Quality Engineering issued an Administrative Order prohibiting
the Town from issuing local sewer permits or from allowing
additional new bedrooms in existing structures with some
exemptions. The "sewer moratorium" precludes the applicants
from obtaining a building permit from the Nantucket Building
Commissioner which covers the full scope of the work allowed by
the Special Permit and the Applicants are under significant time
constaints to begin the renovation work on the garage.
Accordingly, by UNANIMOUS vote, this Board MODIFIES SPECIAL
PERMIT No. 024 -89 so as to allow the Applicants to obtain a
Building Permit and commence renovation of the garage
immediately on the condition that no plumbing facilities will be
tied into the Town sewer system until the "sewer moratorium" is
resolved to the satisfaction of the Nantucket Building
Commissioner and that no plumbing fixtures such as sinks and
toilets will be installed in the second story living area of the
garage until such resolution occurs. Further, once the "sewer
moratorium" is resolved to the satisfaction of the Nantucket

DECISION:
The BOARD OF APPEALS, at a public hearing held on FRIDAY, APRIL 28,
'1989 at 2:30 p.m. in the Town and County Building, Nantucket, made the
following) Decision upon the Application of MAX N. BERRY AND HEIDI L. BERRY,
(024 -89) whose address is 2716 Chesapeake Street, Washington, DC 20008.
1. Applicants, per Zoning By -Law SECTION 139 -33A, seek a SPECIAL
PERMIT to alter and extend a pre - existing, non - conforming garage
on the premises to provide a 2 -bay garage with second floor living and
sleeping facilities. The premises are located at 10 UNION STREET, with
the rear on a privAte way off of Coffin Street; Assessor's Parcels
4231 -043 and 4231 -098; Plan Book 20, Page 10 and Plan Book 7, Page 41 and
Plan Book 10, Page 24, and zoned. RESIDENTIAL -1.
2. Our findings are based upon the Application papers and plans,
and representations and testimony received at our hearing. We find that
the garage structure is a valid, pre - existing, non - conforming structure
which has existed on Parcel 42.3.1 -098 from a time prior to the effective
1972 date of the Zoning By -Law. The off - Coffin Street garage is non-con-
forming as to rear and sideline set back.. The 1314 SF lot on which it is
sited does not meet this minimum lot size requirements for this zoning
district. Vie find that this off- Coffin Street lot has "merged" with the
0.28 -acre 10 Union Street lot on which is sited Applicant's single- family
dwelling. This is by operation of law pursuant to Section 139 -16A of the
By -Law because merger of these same- ownership contiguous lots ovcrcomes
the non - conformity of the under sized off - Coffin Street lot.
3. The Applicant proposes to alter and expand the existing garage
to include second -story living space without enlarging the current
footprint of the garage, all in substantial accordance with the plans
)our Exhibit "A ") of record dated 4/5/89 and prepared by Design Associates.,.
4. We are able to make the requisite findings for a Special Permit
that this reconstruction and conversion of the garage to include second -
floor living space will not be substantially more detrimental to the
neighborhood than the existing garage structure and will be in keeping
with the general purpose and intent of the Zoning By -Law based on the
following: the lack of opposition from any neighbors, the dilapidated
condition of the existing gi,,rage, the willingness of the Applicantsto
accept the condition that no cooking or eating: facilities be constructed
or provided in the renovated garage building, the Applicants' willingness
to limit the use and occupancy of the second story of the garage building
to members of the Applicants' household (including guests, housekeepers
and caretakers), the Applicants' willingness to waive their right to
construct a secondary dwelling on the combined lots, and the mo6est and
tasteful proposed design as shown on the plans.
5. In keeping with our prior decisions, e.g., in 019 -89, 006 -89
and 121 -88, restriction of the residential use of the premises to one
household results in just one dwelling as the principal use with a
permitted accessory use in the garage building.

6. Accordingly, by UNANIMOUS vote, this Board GRANTS the requested
SPECIAL PEWRMIT Under SECTION 139 -33A allowing the proposed alteration
and extension of the pre - existing garage on the premises into a two -
story garage building, in substantial accordance with the Exhibit "A"
plans of record upon the following conditions:
A. The garage building shall include no cooking or eating
facilities;
B. Occupancy of the garage building shall be limited to over-
flow use by members of the Applicants' principal dwelling household,
guests caretaking and housekeeping staff, and it shall not be leased to
others;
C. The Applicants shall construct the garage building in
substantial accordance with the Exhibit "A" plans with such minor changes

Dear Chairman Sherman:
Enclosed herewith for filing on behalf of my clients, Mr.
and Mrs. Max N. Berry, is an application for special permit
relief in respect of the Berry property situated off Coffin
Street in Nantucket. I also enclose a check in the sum of $200
made payable to the Town of Nantucket to cover the filing fee,
supporting plans and other documentation, and two (2) set of
mailing labels.
The applicants seek a special permit pursuant to Section
139 -33a to alter a pre- existing, non - conforming dilapidated
garage into a garage with living quarters upstairs (no kitchen).
Please note that garage lot is held in the same ownership as a
contiguous parcel owned by Mr. and Mrs. Berry and situated at 10

ADDENDUM A
The Applicants, Max N. Berry and Heidi L. Berry, are the
owners of a lot with an existing, dilapidated garage situated
Off Coffin Street; this lot contains approximately 1,314 square
feet. The garage on the lot is in very poor condition; and has
existed on the lot from a time prior to the effective date of
the Zoning By -law. The subject lot is located in the
Residential -1 Zoning District where five (5') foot rear and side
line setback distances are required. The garage is 3.2' from
the rear boundary line and 1.1' from the side boundary line and
is, therefore, non - conforming as to setback requirements.
The Applicants also own a contiguous lot with a primary
dwelling situated at 10 Union Street (Map 4231, Parcel 043).
This lot contains approximately 12,099 square feet, Plan Book
20, Page 110, and is located in the Residentiall Zoning
District. Because the Applicants own both lots in the same name
and the "garage" lot is non - conforming as to minimum lot size
requirements, both lots have "merged" by operation of law in
accordance with the provisions of the Zoning By -law.
The combined area of both lots is 13,143 square feet and the
existing ground cover is 2,208.19 square feet (16,49 %) for both
lots. There is 138.76 feet of frontage for both lots.
The Applicants seek Special Permit relief to alter the
existing, non - conforming garage by converting it into a garage
with upstairs living quarters (no kitchen) in accordance with
the plans as filed and Section 139 -33(a) of the By -law. No
increase in ground cover and /or increase in setback
non - conformities is proposed. The applicants are willing to
limit use of the garage to household members and guests to
impose a restriction against rental on the garage, and to forego
constructing a secondary dwelling on the combined lots.
The requested relief will not be substantially more
detrimental to the neighborhood than the current garage use, nor
will a grant of relief derogate from the intent and purpose of
the Zoning By -law, because the existing garage is in a state of
disrepair and unusable in its present condition. The proposes
alteration will provide the Applications with off - street,
enclosed parking, and the Applicants are willing to restrict the
use of their property in a manner which is beneficial to and in
harmony with the intent and purpose of the Zoning By -law.

relief in respect of the Berry property situated off Coffin
Street in Nantucket. I also enclose a check in the sum of $200
made payable to the Town of Nantucket to cover the filing fee,

ADDENDUM A
The Applicants, Max N. Berry and Heidi L. Berry, are the
owners of a lot with an existing, dilapidated garage situated
Off Coffin Street; this lot contains approximately 1,314 square
feet. The garage on the lot is in very poor condition; and has
existed on the lot from a time prior to the effective date of
the Zoning By -law. The subject lot is located in the
Residential -1 Zoning District where five (5') foot rear and side
line setback distances are required. The garage is 3.2' from
the rear boundary line and 1.1' from the side boundary line and
is, therefore, non - conforming as to setback requirements.
The Applicants also own a contiguous lot with a primary
dwelling situated at 10 Union Street (Map 4231, Parcel 043).
This lot contains approximately 12,099 square feet, Plan Book
20, Page 110, and is located in the Residentiall Zoning
District. Because the Applicants own both lots in the same name
and the "garage" lot is non - conforming as to minimum lot size
requirements, both lots have "merged" by operation of law in
accordance with the provisions of the Zoning By -law.
The combined area of both lots is 13,143 square feet and the
existing ground cover is 2,208.19 square feet (16,49 %) for both
lots. There is 138.76 feet of frontage for both lots.
The Applicants seek Special Permit relief to alter the
existing, non - conforming garage by converting it into a garage
with upstairs living quarters (no kitchen) in accordance with
the plans as filed and Section 139 -33(a) of the By -law. No
is
increase in ground cover and /or increase in setback
non - conformities is proposed. The applicants are willing to
limit use of the garage to household members and guests to
impose a restriction against rental on the garage, and to forego
constructing a secondary dwelling on the combined lots.
The requested relief will not be substantially more
detrimental to the neighborhood than the current garage use, nor
will a grant of relief derogate from the intent and purpose of
the Zoning By -law, because the existing garage is in a state of
disrepair and unusable in its present condition. The proposes
alteration will provide the Applications with off - street,
enclosed parking, and the Applicants are willing to restrict the
use of their property in a manner which is beneficial to and in
harmony with the intent and purpose of the Zoning By -law.
