Enclosed is the decision of the Board of Appeals which has this
day been filed with the Nantucket Town Clerk.
An appeal from this decision may be taken pursuant to Section 17
of Chapter 40A, Massachusetts General Laws. Any action appealing
the decision must be brought by filing a complaint in court
within twenty (20) days after this date. Notice of the action
with a copy of the complaint and certified copy of the decision
must be given to the Town Clerk so as to be received within such
twenty (20) days.

At a public hearing on Friday, February 10, 1989, at
1:00 p.m. in the Town and County Building, Nantucket, on
the Application (010 -89) of DR. JORDAN GOODMAN and MRS.
ZELDA GOODMAN having an address at 2688 La Casita Avenue,
Las Vegas, NV 89120, the Nantucket zoning Board of Appeals
made the following DECISION:
1. Applicants seek a Special Permit under zoning Bylaw
Section 139 -7C to install an Accessory Apartment on the
third -floor of their existing single- family dwelling. The
premises are located at 11 Gardner Street, Assessor's
Parcel 42.3.3 -014, Plan Book, Page 11, zoned Residential
Old Historic.
2. Our findings are based upon the Application papers
including plot plan, floor plan for the third -floor space
and photoprints of the 2 -1/2 story dwelling, also viewing
and represeiTtations and testimony received at our hearing.
3. We find that Applicants' dwelling is sited on their
7,460 -SF lot so as to accommodate at least two off - street
parking spaces. The third -floor is said to have the
required second means of egress for use as an Accessory
Apartment. They are mindful of the numerous conditions
which must be met for lawful installation of an Accessory
Apartment, including the covenant of year -round occupancy.
4. Since Applicants' circumstances are those for which
Accessory Apartments are favored and no objection was
heard, we are able to make the necessary finding that the
relief sought is in harmony with the general purpose and
intent of the zoning Bylaw.
5. Accordingly, by unanimous vote, this Board grants to
Applicants the requested Special Permit under Section
139 -7C to install and make available for use on the third
floor of their dwelling an Accessory Apartment, subject to
the conditions set forth in Section 139 -7C.
