Enclosed is the decision of the Board of Appeals which has this
day been filed with the Nantucket Town Clerk.
An appeal from this decision may be taken pursuant to Section 17
of Chapter 40A, Massachusetts General Laws. Any action appealing
the decision must be brought by filing a complaint in court
within twenty (20) days after this date. Notice of the action
with a copy of the complaint and certified copy of the decision
must be given to the Town Clerk so as to be received within such
twenty (20) days.

At a public hearing on Friday, February 10, 1989, at
1:00 p.m. in the Town and County Building, Nantucket, on
the Application (004 -89) of RICHARD GREEN and DENISON
BUCKLEY having an address at Box 354, Siasconset, MA
02564, the Nantucket zoning Board of Appeals made the
following DECISION:
1. Applicants seek a Special Permit under Section 139 -33A
of the zoning Bylaw to alter and extend three
nonconforming structures, combining them into one
single - family dwelling with ground cover increased by 181
SF to 1,518 SF on their 3,606 SF lot. The premises are at
19 Bank Street, Codfish Park, Siasconset, Assessor's
Parcel 73.1.3 -060, Plan Book 303, Page 14, zoned
Residential -1.
2. Our findings are based upon the Aplication papers
including ANR plan of the lot and a 3 -sheet set of
drawings (our Exhibit "A") showing proposed alterations on
a site plan, floor plans and elevations, also
correspondence and representations and testimony received
at our hearing.
3. Applicants' lot was created, or its bounds clarified,
by 11/13/87 Planning Board endorsement of a plan of the
land "approval under the Subdivision Control Law not
required ". As shown on that plan, their lot is a corner
lot on Bank Street between Jackson Street to the south and
Jefferson Street to the north. As noted during the
hearing, the very densely settled Codfish Park is subject
to a Town claim of paramount title. We act upon this
request for relief, therefore, upon Applicants'
representation of ownership, without attempting to resolve
any title issue.
4. On the lot now are two single- story, single- family
dwellings, a garage /shed and a small storage shed. Only
the main dwelling is sited outside the required setbacks.
The two dwellings are nonconforming in their relative
placement. Each of the buildings is represented as
pre- dating 1972 zoning; hence, relief by Special Permit
under Section 139 -33A is appropriate.
5. Applicants propose to link up the main dwelling with
the little house by 38 -SF connector and with the garage by
95 -SF connector. These with a proposed lean -to type 48 -SF
greenhouse off the kitchen, make up the 181 -SF total of
added ground cover. Ground cover ratio will be increased

from 37% to 42 %, a ratio of 30% being allowed. A partial
second floor is to be added to the main house. Of the
added structure, only the little -house connector will
extend into a setback, but here the extension is less than
setback intrusion of the existing little house. One
off - street parking space will be added.
6. Neighbors who expressed their views were supportive of
Applicants' proposed upgrading of the premises. No
opposition was heard. We find that the alterations will
not be substantially more detrimental to the neighborhood.
Rather, the relief asked will be in harmony with the
general purposes and intent of the zoning Bylaw.
7. Accordingly, by unanimous vote, this Board grants to
Applicants the requested Special Permit under Section
139 -33A to combine the two dwellings and the garage into a
single - family dwelling in substantial conformity with
Exhibit "A ".

NOTICE
January 26, 1989
A public hearing of the Board of Appeals will be held
on Friday, February 10, 1989, at 1:00 p.m. in the Town
and County Building, Nantucket, on the Application of:
RICHARD GREEN and DENISON BUCKLEY

seeking a Special Permit under Section 139 -33A to alter
and extend 3 nonconforming buildings and their use, said
to pre -date 1972 zoning, by constructing two connecting
portions, one between the principal single - family dwelling
and a secondary dwelling sited to the south and the other
between the principal dwelling and an accessory building
to the northeast. The 4 buildings on the 3,606 SF lot are
sited within the required front, side or rear yard
setbacks. The only new construction proposed within a
setback is the connecting portion between the dwellings,
but its intrusion is to a lesser extent. In connecting the
3 buildings to form one larger single - family dwelling (a
portion of which will be 2- story), the present 1,337 SF
ground cover (37% GCR) will be increased by 181 SF to
1,518 SF (42% GCR), 30% being the allowable ground cover
ratio.
Relief by Variance from Section 139 -16A is also requested
to the extent it may be needed to validate the premises
with the proposed changes.

Dear Members,
Please find enclosed an application for relief from some zoning
restrictions in relation to work we would like to do on our home.
We are a family of five and have been living in the house in Codfish
Park for 13 years.We have finally been able to purchase the property
and now wish to expand our use of the existing buildings.
Until now we have been using the central building as our dwelling,
with the three children sleeping together in the larger room at the
front, the two adults in the smaller one, with living and eating in
the kitchen. The garage we use for the washer /dryer, play area,closets
and storage.The smaller building to the South was rented by the owner
to someone else.
Now we would like to change the property as showm on the accompanying
plans to provide separate bedrooms for the family members. There
would be a bedroom and sitting area for the parents in the small
Southerly portion, now connected as shown to the central portion,
which contains living and dining areas where the bedrooms were, and
a small room each for the girls with a shared bathroom upstairs. The
kitchen remains where it is, with a greenhouse added on the South
side to provide solar gain in the winter and to accomodate our love
of plants and gardening.
The kitchen would connect via a breakfast area cum entrance area
to the Northerly portion, which would provide storage at the front,
a room for our son in the middle, and a laundry and bathroom at the
rear. The passageway on the South side also acts as a solar green-
house with its' glass doors.
I have designed these improvements very carefully in order to solve
our problems of space with a minimum of additional ground cover and
impact on the neighbourhood, keeping everything as low and compact
as possible consistant. with the Building Code.

As I say, we have been living here inthis house for 13 years, our
children are growing up here; it is our home, not a spec. house,
vacation house or investment property. We love our neighbourhood and
wish to preserve its' unique character, and we feel that the changes
presented here will be an improvement to the neighbourhood, and will
have no negative impact whatsoever on any of our neighbours.
