An appeal from this decision may be taken pursuant to Section 17 of Chapter 40A, Massachusetts General Laws. Any action appealing the decision must be brought by filing a complaint in court within twenty (20) days after this date. Notice of the action with a copy of the complaint and certified copy of the decision must be given to the Town Clerk so as to be received within such twenty (20) bays. William R. Sherman, Chairman cc: Building Commissioner Planning Board Town Clerk ZONING BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a public hearing held on FRIDAY, JANUARY 13, 1989, at 1:30 p.m. in the Town and County Building, Nantucket, Massachusetts made the following DECISION upon the /' Application of MIMI YOUNGAand the ESTATE OF BRACEBRIDGE YOUNG (122 -88), whose address is P.O. Box 342, 8 King Street, Siasconset, Massachusetts 02564. 1. The Applicant, per Zoning By -Law SECTION 139 -7 and 139 -33A, seeks a SPECIAL PERMIT to convert the existing garage on the Premises to a secondary dwelling. The Premises are located at 8 King Street, Siasconset, Massachusetts, Assessor's Map 7313, Parcel 040, as evidenced by Deed recorded in Book 131, Page 394 at the Nantucket Registry of Deeds. The Premises are zoned RESIDENTIAL -1. 2. Our findings are based upon the Application papers and plans, and representations and testimony recieved at our hearing. We find that the garage structure is a valid pre- existing and non - conforming structure which is non - conforming because it intrudes approximately 3 feet into the westerly 5 foot sideline setback area. The subject lot includes approximately 13,830 square feet where a minimum lot size of 5,000 square feet is required. The garage structure complies with all of the secondary dwelling requirements set forth in Page One of Three A r, SECTION 139 -7(2) of the Zoning By -Law except for SECTION 139-7A (2)(d) which provides that the dwelling shall comply with all other Zoning By -Law regulations. 3. We are able to make the requisite findings for a SPECIAL PERMIT that the conversion of the existing garage to a secondary dwelling will not be substantially more detrimental to the neighborhood than the existing garage structure and will be in keeping in the general purpose and intent of the Zoning By -Law given the lack of opposition from any neighbors, the ample size of the Applicant's lot, compliance of the garage structure with all secondary dwelling requirements except for the sideline setback non - conformity, and the Applicant's willingness to limit the use of the proposed secondary dwelling to household members (including housekeepers and caretakers) and the Applicant's willingness to restrict the secondary dwelling and the primary dwelling on the Premises from any separate rental to third parties. 4. Accordingly, by UNANIMOUS VOTE, this Board GRANTS the requested SPECIAL PERMIT under SECTIONS 139 -7 and 139 -33A allowing the conversion of the pre- existing garage on the premises to a secondary dwelling in accordance with the plans submitted with the Application upon the following conditions: A. Use and occupancy of the proposed secondary dwelling shall be limited to household members of the Applicant including housekeepers and caretakers; B. The primary dwelling and proposed secondary Page Two of Three dwelling shall be used by the Applicant and members of her household, including housekeepers and caretakers, and neither dwelling shall be leased separately to third parties without further relief from this Board; and C. The garage conversion to the proposed secondary dwelling is completed in accordance with the plans filed with this Application after same have been approved by the Historic District Commission.
