OWEN having an address at 107 Tall Timbers Lane, Glastonbury, CT 06033, the Nantucket zoning Board of Appeals made the following DECISION: 1. Applicants seek a Special Permit under zoning Bylaw Section 139 -33A to alter and extend their single - family dwelling about 4 feet westerly without increasing its existing intrusion about 5 feet into the required front -yard setback. Other portions of the proposed addition will lie outside any required setback. 2. The premises are located at 2 Sherburnee Turnpike (aka Avenue); Assessor's Parcels 30 -179, 30 -210 and 30 -220; Plan Book 170, Page 281; zoned Residential -1. 3. Our findings are based upon the Application papers including a set of 3 drawings "Proposed Additions - - -" dated "rev. Aug. 31st, 188" (our Exhibit "A"), viewing, and testimony and representations at our hearing. 4. We find that Applicants' residence was constructed well prior to the 1972 adoption of zoning. It is sited on an oversized 17,397 SF lot, comprised of 3 Assessor's Parcels in their common ownership, as close as 5 feet from the 100 -foot frontage on Sherburne Turnpike. The northwesterly corner is 5.4 feet from the front lot line and is the point from which the addition will extend the present front building line in the westerly direction about 4 feet. Since that building line is slightly further from the street line at its westerly end, the 4 -foot addition will not increase the depth of the nonconforming intrusion into the required 10' front yard. Other portions of the proposed addition, notably a wing extending to the rear of the house, are not within any required setback. 5. The Planning Board's recommendation was favorable, and no opposition was heard. We make the requisite findings that the addition will not be more detrimental to the neighborhood but in harmony with the general purpose and intent of the zoning Bylaw. 6. Accordingly, this Board by unanimous vote grants to Applicants the requested Special Permit under Section 139 -33A to construct the proposed addition to their dwelling, in substantial conformity with Exhibit "A ".
