An appeal from this decision may be taken pursuant to Section 17 of Chapter 40A, Massachusetts General Laws. Any action appealing the decision must be brought by filing a complaint in court within twenty (20) days after this date. Sherman, Chairman BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 Decision: At a public hearing of the BOARD OF APPEALS on Friday, October 14, 1988, at 2:30 p.m. at the Town and County Building, Nantucket, on the Application (099 -88) of EDWARD and ANNABEL KATZ of 8711 Bellwood Road, Bethesda, Maryland 20817, the Nantucket Zoning Board of Appeals made the following DECISION: 1. Applicant seeks a Special Permit under the Zoning Code Section 139 -33A to alter a pre- existing, non - conforming residential building by constructing a single story storage shed to be attached to the existing residence. The premises are located at 51 Walsh Street, Assessor's Map 29, Parcel 61, Plan Book 23, Page 48 in the Zoning District Residential -1. 2. Our findings are based on the application papers, a copy of the recorded plan with the ground cover calculations for the existing structure shown thereon and a plan for the storage area submitted to the Board at the hearing and marked as Exhibit A, along with testimony and representations. 3. The existing ground cover ratio for structures on the property is 31.4 %. Permissible ground cover in this zone is 30 %. The addition will be 8' x il' therefore raising the ground cover ratio to 32.56 %. 4. We heard no opposition and given that there are no outside storage facilities currently on the premises for bicycles, etc., and the small incremental increase in ground - Page One of Two - cover, we see no detriment to the neighborhood in connection with applicant's proposed addition. The storage shed, as shown on Exhibit A, will provide a place to get outdoor equipment safely out of sight. We therefore find that the proposed addition will not be substantially more detrimental to the neighborhood than the existing non - conformity and in harmony with the general purpose and intent of the Zoning By -Law. 5. Accordingly, this Board by a vote of four in favor and one against grants to the applicant the requested Special Permit under Section 139 -33A to construct the proposed addition in substantial conformity with the Exhibit A plan.
