McNALLY, MARY K. McNALLY, owner, having an address at 23 Meadowview Drive, Nantucket, MA 02554 the Nantucket zoning Board of Appeals made the following DECISION: 1. Applicant and owner seek a Variance from the 10 -foot rear lot -line setback required by zoning Bylaw Section 139 -16C to validate the existing siting of a garage - apartment secondary dwelling. The outside stairway landing at the second -floor apartment level of that building intrudes about 8" into such setback. 2. The premises are located at 23 Meadowview Drive, Assessor's Parcel 56 -283, Land Court Plan 14830 -I, Lot 113, zoned Residential -2. 3. Our findings are based upon the Application papers including 5/16/88 survey plan detailing the intrusion (showing the McNallys as joint owners) and 9/29/82 plot plan updated 8/31/88 to show the intrusion, viewing, and representations and testimony received at our hearing. Also, we have taken into account the record in our file 022 -82 resulting in the 9/21/82 variance granted to Dr. McNally. 4. We find that the garage - apartment was constructed on the 20,016 SF lot pursuant to Building Permit 2716 -83 and in substantial conformity with the 022 -82 variance. The latter allowed siting of the secondary dwelling without the 12' front -to -rear spacing relative to the principal dwelling, required by Section 139- 7A(3)(a). It was granted in view of the unusual lot shape: front lot line bowed in on a 200' radius resulting in about 60' lot depth where the garage - apartment can be placed. Since a 30 -foot front yard and 10 -foot rear yard are required R -2 setbacks, the depth of lot makes siting difficult. 5. The only intrusion is due to the upper stairway landing. The Massachusetts Building Code mandates that its dimensions not be less than 3' x 31. The zoning violation cannot simply be cured, then, by removing an 8" portion of the landing. The Building Code also requires the second means of egress provided by the outside stairway, while aesthetic requirements of the Historic District Commission militate against relocating the entire stairway and landing to another, more public side of the building. File No. 097 -88 6. No opposition to relief was heard, while several neighbors were supportive. The Planning Board's recommendation was favorable. To the extent we are constrained by case law not to grant a second variance based upon the same finding of hardship as a first, we could here find that the relief sought is in the nature of a modification to the 022 -82 variance serving the same purpose of accommodating the building in the narrow depth of the lot. Had the question of the original variance request come before us now, however, rather than being settled in 1982, conformity with our other decisions would have required denial of relief. We prefer, therefore, to treat this as a request for Special Permit under Section 139 -16C, for which we need only find that the relief would be in harmony with the general purpose and intent of the zoning Chapter. We so find, noting that no zoning or other public purpose would be served by denying relief for what the record shows to be an entirely innocent, small error in siting. 7. Accordingly, by unanimous vote this Board grants to Applicant /owner the requested relief from the 10' rear -yard requirement of Section 139 -16C to validate the siting of the existing garage - apartment building with second -floor stairway landing, but not by variance, rather by Special Permit under Section 139 -16C.
