DECISION:
At a public hearing oz -S on
Monday, July 11, 1988 at 4:00 p.m. in t.... and
County Building, Nantucket, on the Application (072 -88) of
the Town of Nantucket, Broad Street, Nantucket, MA 02554.
1. Applicant seeks a Special Permit under zoning Code
Section 139 -33A to alter and extend the existing
SIASCONSET WASTEWATER TREATMENT FACILITIES substantially
as shown and described in EPA Project Number C250- 473 -03
in Town records. The premises are located at 24 'Beach
Road; Assessor's Parcels 74 -052, 74 -059 through 74 -068,
and 74 -073; Plan Book 3, Page 3,Blocks 30, 6, 24 and Lots
25, 5, 4, 26, 27, 3, 2(sewer beds) and - (beachland); in
the zoning district Limited Use General -3.
2. Our findings are based upon the Application papers
including the Location Plan and Drawing Index dated
9/12/86, Sheet 2 of 16 (our Exhibit "A") and
correspondence, representations and testimony received at
our hearing of July 11, 1988 to which the matter was
continued. We note that Applicant's payment of the usual
application fee was waived by our unanimous vote to avoid
purposeless Town accounting.
3. According to Applicant's representatives, the proposed
upgrading to a primary wastewater treatment facility for
Siasconset is a culmination of years of planning and
facilities rehabilation pursuant to Federal and State
grants. Much of that concerned Town center and Surfside
facilities: see related application 073 -88. Amoung the new
Siasconset structures will be preliminary treatment
facilities and primary clarifiers. With these, most solids
are removed from the flow arriving via the 10" and 12"
sewer lines coming to the site. The clarified liquid will
then be passed on to infiltration basins, the 6 of them
being formed as rectangular sand pits. As liquid
percolates through the sand below the basins, purification
occurs by anaerobic processes, in a manner comparable to
the higher level secondary treatment process. Solid sludge
accumulated in the clarifiers is to be removed
periodically, taken to the Surfside treatment facility for
co- composting and conversion into a benign soil additive.
4. By contrast, the existing facility, which long predates
1972 adoption of zoning, involves no clarifiers. Waste
water is simply run into sewer beds from the outfall ends
of the existing sewer lines, without prior treatment.
5. Where the existing access road is unpaved, Applicant
proposes to provide a paved roadway to the control
building. Now, tank trucks used in pumping out solids
accumulated in private Siasconset septic systems dispose
of this pumpage directly into the sewer beds. The proposed
facility will have a receiving station for such pumpage
and treat it first in the clarifiers. Management of the
facility is provided for in a single -story control
building to have a 16' x 21110" footprint. New monitoring
wells will be placed on the site to assure against ground
water contamination beyond the area where a Class 3 rating
of ground water applies. To safeguard against unauthorized
entry into the infiltration basins, a 6 -foot high
vinyl- coated, chain -link fence will surround them.
6. Abutters and others who expressed their views were
concerned with visual impact of the facility, with odors,
and with continued passage to the beach via the access
road. Applicant undertakes to do extensive revegatation
and add native plantings for a maintainable, natural
screening of the fencing, control building and associated
structures. To meet requirements of the Nantucket
Conservation Commission ( "ConCom ") and for security and
insurability, Applicant's ability to lower the profile of
the fence is limited. Color of cladding will be selected
to be relatively unobtrusive. Applicant must meet the
aesthetic requirements of the Historic District Commission
("HDC") for all structures seen by the public. Applicant
further undertakes to keep passable the connection between
the paved access road and the unimproved way to the beach.
Finally, the facility will have a sludge holding tank
covered so that improved odor control may be achieved.
7. Planning for the project has been subject to extensive
State and Federal review, Town Meeting approvals obtained
and extensive opportunity given for prior public input.
The high level of available State and Federal funding
gives further evidence that the facility is in the
public interest. Delay occasioned by failure of needed
local approvals puts such funding at risk. Applicant, we
understand, has a legal obligation to provide proper
wastewater treatment and so might face heavy burdens if
relief were denied. The Planning Board's recommendation
was favorable.
8. We have no difficulty in finding that the relief sought
is in harmony with the general purpose and intent of the
zoning code, notably, to promote public health. Indeed,
the zoning code is anomolous in not characterizing such

uses. In any event, the Siasconset facility long predates
1972 adoption of zoning and so is permitted under Section
139 -33A as a 'grandfathered` use. As required for a
Special Permit under that Section, we further find that
the proposed upgrading to a primary treatment facility
will not be substantially more detrimental to the
neighborhood than the existing facility, upon the
condition that Applicant extend its best efforts to
minimize adverse visual impact of the new facility
consistent with safety, security, insurability and
applicable requirements of governmental agencies including
the HDC and ConCom.
9. Having made the requisite findings, this Board by
UNANIMOUS vote grants to Applicant the requested Special
Permit pursuant to Section 139 -33A, subject to the
above -noted condition.

1. The plaintiff Noel Thompson (hereinafter
"Thompson ") is an individual with a residence at Low Beach Road
in the Siasconset area of Nantucket, Nantucket County,
Massachusetts.
2. The defendants in this action are the members of
the Nantucket Board of Appeals (hereinafter "Board ") a
governmental body with an office at the Nantucket Town Hall,
Nantucket, Nantucket County, Massachusetts. The defendant

3. The defendant Town of Nantucket (hereinafter
"Town ") is a governmental entity, and was the successful
applicant for a special permit in this case. The town has an
agent of service through the Nantucket Town Clerk at Broad
Street, Nantucket, MA 02554.
JURISDICTION AND VENUE
4. This action is an appeal of the Board of Appeals:
granting of a special permit pursuant to the provisions of
Mass. G. L. c. 40A, §17, and is commenced in the Nantucket
Superior Court, since the subject property is located in
Nantucket County.
HISTORY OF ACTION
5. Thompson owns a home and other property directly
abutting the existing Siasconset Wastewater Treatment
facilities located at 24 Beach Road, as shown as Assessor's
Parcels 74 -052, 74 -059 through 74 -068 and 74 -073; Plan Book 3,
Page 3, Blocks 30, 6, 24 and Lots 25, 5, 4, 26, 27, 3, 2 (sewer
beds and beachland) (hereinafter "the property ").

6. Thompson's parcels are more particularly described
in deeds recorded at the Nantucket County Registry of Deeds at
Book 165, Page 235 and Book 205, Page 200.
7. The Town petitioned the Board for a special permit
pursuant to Nantucket Zoning Code §139 -33A to alter and extend
its existing wastewater treatment facilities. A copy of the
general plan for the project is attached hereto as Exhibit "A ".
8. On July 11, 1988, the Board conducted a public
hearing and voted to approve the special permit.
9. The Board's decision was filed with the Nantucket
Town Clerk on July 29, 1988. A certified copy of that decision
is attached hereto as Exhibit "B ".
CAUSE OF ACTION
10. As a direct abutter to the subject property,
Thompson is an aggrieved party within the meaning of Mass. G.
L. c. 40A, §17.
11. At the public hearing, Thompson, through counsel,
appeared before the Board to express concerns regarding the
intrusion of the new facility into a residential area, the
adverse visual impact of the facility, the noxious fumes and
odors associated with the facility, and problems relating to
access through a new paved roadway used for this facility.
12. The project cannot be constructed without creating
a substantial detriment to the neighborhood, in terms of visual

impact, noise, noxious odors, increased vehicular travel
throughout the neighborhood, and a diminution in residential
property values throughout the neighborhood.
13. In granting a special permit allowing construction
which would result in a substantial detriment to the
neighborhood, the Board was clearly erroneous, and exceeded its
authority.
14. By permitting this project despite the legitimate
concerns raised by abutters and other neighbors, the Board
acted arbitrary and capriciously.
15. By granting the special permit without imposing
conditions which would answer the concerns of the abutters, the
Board acted arbitrarily and capriciously.
16. The granting of this special permit derogates from
the purpose and intent of the Nantucket By -law.
17. As a direct and proximate result of the Board's
actions, Thompson will be directly and substantially harmed in
the quiet of enjoyment of his property, in the adverse impact
upon the quality of life in his home, in the adverse impact
upon the neighborhood in general, and in the diminution in
property value of his home and that of the entire neighborhood.

WHEREFORE, Thompson respectfully requests that this

Appeals and declare it to be of no force and effect;
