Sherman, Chairman cc: Building Commissioner Planning Board Town Clerk 'Poo, 0 44,/, BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 At a public hearing on Friday, August 5, 1988 at 1:30 p.m. in the Town and County Building, Nantucket, on the Application (061 -88) of STEPHEN AND JENNIFER PARADIS having a mailing address of Box 3189, Nantucket, MA 02584, the Nantucket zoning BOARD OF APPEALS made the following DECISION: 1. Applicants seek a Special Permit under zoning Bylaw Section 139 -7C to install a year -round Accessory Apartment in their proposed single - family dwelling to be built on the lot they now own. The premises are at 28 Grove Lane, Assessor's Parcel 41 -436, Plan Book 18, Page 68, Lot 8, and zoned Residential -2. 2. The Application was originally set for hearing on June 17, 1988, but was continued pending appointment of this five - person Board. Our findings are based upon the Application papers including site plan showing the proposed building location, first and second floor plans and 4 elevations (together identified as our Exhibit "A "), and representations and testimony received at our hearing. 3. As shown on the site plan, Applicants' lot conforms with the minimum lot area (20,000 SF) and frontage (75 feet) requirements in the R -2 zone. Wetlands extend across a portion of the frontage on Grove Lane and generally to the northeast of the lot, and a ditch runs just inwardly of the rear lot line to the south. The house is accordingly sited toward the rear of the lot with entry drive along the westerly lot line. Off- street parking will be provided for at least two cars, as required by Section 139 -18. 4. Applicants wish to provide the Accessory Apartment on the second floor to ease financial burdens connected with ownership of the property, by renting the apartment out to an employee of Stephen Paradis Construction or others who would take occupancy on a year -round basis. This is entirely consistent with the zoning purposes stated in Section 139 -7C(1) for allowing Accessory Apartments by Special Permit. Applicants, we understand, are prepared to comply with all the conditions put upon Accessory Apartments in Section 139 -7C(2) including execution of the year -round residency covenant as specified in Subsection (g) 5. The Planning Board's recommendation was favorable, and no opposition was heard. Accordingly, we make the required finding that the requested relief is in harmony with the general purpose and intent of the zoning Bylaw. We are told that Applicants will be seeking a Certificate of Appropriateness from the Nantucket Historic District Commission ( "HDC ") but do not have of record their status with respect to the Conservation Commission. 6. By unanimous vote, this Board grants to Applicants the requested Special Permit under Section 139 -7C to install the proposed Accessory Aartment in substantial conformity with the Exhibit "A" plans (subject to those changes required for aesethetic approval by the HDC.)
