Sherman, Chairman BOARD OF APPEALS cc: Building Commissioner Planning Board Town Clerk BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS DECISION: The Board of Appeals at a public meeting held on Friday, May 20, 1988, at 1:30 P.M. in the Town and County Building, Nantucket, made the following decision upon the application of Black Fin Realty Trust, Michael J. Houlihan, Trustee (056 -88), address P. 0. Box 1120, Hyannis, MA 02602. 1. Applicant sought a VARIANCE pursuant to 139 -32A from the front yard setback requirement of 139 -16tof the Nantucket Zoning By -law as it may apply to a paper road Ballantyne Lane. Applicant also reserved at the hearing its right to challenge the application of the front yard setback to Ballantyne Lane in the first instance. Assuming for these purposes that such a front yard requirement does apply to Ballanytne Lane, the relief sought would allow the construction -of a new single - family dwelling that would be 10.5 feet from Ballantyne Lane at its closest point. 2. The locus is presently vacant land situated at 33 Baxter Road, Siasconset, Nantucket, Massachusetts. It is shown as Assessor's Parcel 007 on Map 49.2.3, and as Lot 2 on a plan filed in Nantucket Registry of Deeds, Plan File 30 -B. The locus contains approximately 21,818 square feet of area, a substantial portion of which is unsuitable for building, and is zoned R -2. The front yard setback requirement for this zone is 30 feet. 3. Our findings are based upon the Application papers, including a Certificate of Appropriateness No. 17864, plans accompanying the application, plans, photographs, copies and prints received at the hearing and representations at our hearing, and an Order of Conditions No. N -1965 (D.E.Q.E. No. 456) issued by the Nantucket Conservation Commission. 4. In support of Applicant's request for a VARIANCE under 139 -32 we find, as follows: Owing to circumstances relating to soil conditions, shaper topography of the land, but not affecting generally the zoning district, a strict application or enforcement of the front yard setback requirements to Ballantyne Lane will work a substantial hardship, financial or otherwise on Applicant. Ballantyne Lane is an unconstructed paper road which was part of the original subdivision known as Aurora Heights. Counsel for applicant represented, uncontested, that there are no public rights in this way. We make no specific finding as to the rights of third parties in and over Ballantyne Lane and note that this decision shall not affect those rights, if any. The proposed structure is to be sited 10.5 feet from Ballantyne Lane and 10.5 feet from the northerly boundary, centering it on the lot. The proposed structure and its siting have received approvals from both the Nantucket Historic District Commission and the Nantucket Conservation Commission. Moreover, a significant portion of the lot is land constituting a coastal bank and land below such bank which abuts to the east, the Atlantic Ocean. Given the location of Ballantyne Lane in relation to the topography, it cannot provide vehicular access to the east of the locus. 5. Granting relief hereby will not derogate from the Zoning By -law's intent and purpose and will not cause detriment to the public good. Moreover, our granting relief is consistent with the reasonable application of our front yard setback requirements to lots having frontage on more than one street. Here, the proposed structure is sited approximately 60 feet back from Baxtr-r Road. 6. THEREFORE, upon a motion duly made and seconded, this Board voted UNANIMOUSLY to grant Applicant relief by VARIANCE to reduce so much of the front yard setback requirement from Ballantyne Lane, only, to allow the placement or construction of a single- family dwelling structure, substantially in accordance with the H.D.C. and Conservation Commission approved plans, which will be 10.5± feet from Ballantyne Lane at its closest point.
