DECISION:
The BOARD OF APPEALS at a Public Hearing held on Monday,
March 28, 1988 at 1:30 p.m. in the Town and County Building,
Nantucket, made the following DECISION upon the Application of
Edmond. M. Reggie and Doris B. Reggie (036 -88), 18 Gardner Road,
Nantucket, Massachusetts 02554.
1. Applicant seeks a special permit under Aoning
By -Law Section 139 -33A to permit the expansion of the existing
structure so as to include a bathroom addition within the 35
foot front yard setback. The premises are located at 18 Gardner
Road, Nantucket, Massachusetts, Assessors Parcel 48 -135, Land
Court Plan No. 11461 -Ti and zoned Limited Use General -1.
2. Our findings are based upon the 036 -88 application
papers and plans, and. representations and testimony received at
our hearing. The existing house is currently validly
pre - existing and nor.- conforming with respect to the front yard
setback. Its closest point is 23 feet from the front property
line. The proposed addition will not make this existing
non - conforming distance more non - conforming as no part of the
addition is less than 23 feet from the front boundary.
3. In light of the distance of nearly 100 feet from
the closest point of the house from the actual traveled way as
shown on the plan submitted with the application and the fact
that the proposed addition will not increase the existing

or
non - conformity, it is the opinion of the Board that the addition
will not be substantially more detrimental to the neighborhood
than the existing non- conformity.
4. As a condition of this Special Permit and so as to
minimize other_ construction within the front yard setback area,
this relief is specifically conditioned upon no additional
structures being constructed in the front yard setback area. It
is noted that the proposed addition shall be one story in height
and, of the dimensions shown on the plan submitted with the
application.
5. Subject to the foregoing conditions this Board by
UNANIMOUS vote GRANTS to the Applicant the requested. Special
Permit under Section 133 -33A.

The applicant seeks a Special Permit pursuant to Section 139 -33 of the by-law
to permit expansion of the existing structure so as to include a new bathroom.
The existing structure is twenty -three feet (23') from the front boundary. . The
front yard set back requirement is-thirty-five (35) feet.- The proposed bathroom
addition will not make this existing non-conformity distance n

EXHIBIT "A"
The applicants, Edmund M. Reggie and Doris B. Reggie, seek a
Special Permit pursuant to section 139 -33 of the By -Law to allow
for the addition of a bathroom on the easterly side of the
house. The existing house is 23 feet from the front boundary
line of the property and the front yard setback requirement in
this zoning district is 35 feet. The proposed bathroom addition
would also be 23 feet from the front yard boundary. Copies of
the plot plan showing the existing structure, plot plan showing
the proposed addition, and floor plans are attached hereto.
The property is situated at 18 Gardner Road, Shimmo,
Nantucket, Massachusetts and is shown as Lot 25 on Land Court
Plan 11461 -H filed with Certificate of Title No. 2020 at the
Nantucket Registry District. The existing dwelling on the
premises pre -dates the effective date of the Nantucket Zoning
By -Law as evidenced by a mortgage from predecessors in title
Robert W. Carrick and Doris F. Carrick to the Nantucket
Institution for Savings dated September 5, 1972 and recorded as
Document No. 13764 noted on Certificate of Title No. 6599 at
said Registry District. As of July, 1972, the property was
zoned residential and the intensity regulations for the
residential zoning district were 5,000 square feet minimum lot
size; no front yard setback requirement, 75 feet minimum
frontage and a ground cover ratio of 20 %. In March, 1973, the
property was upzoned to LUG -1 which provided for the current
intensity regulations, including the 35 foot front yard setback
requirement. Thus, it is clear that the current dwelling
existed prior to the effective date (1973) of the - current LUG -1
intensity regulations. On November 5, 1976, the Nantucket
Building Department issued Building Permit 495 -76 for
construction of a small 10 by 10 foot addition to the
northwesterly side of the house. This addition created no
zoning non - conformities. A copy of the building permit
application dated November 5, 1976 is annexed hereto.
The subject lot has an area of 47,300 square feet. The
proposed house on the lot is 35 feet from the southeasterly
boundary line, 128 feet from the rear boundary line and 87 feet
from the northwesterly boundary line. The current house, at its
closest point, is 23 feet away from the front boundary line.
The current house on the premises has a ground cover of 982
square feet and the shed on the premises has a ground cover of
88 square feet, for a total of 1,070 square feet. The proposed
additions to the house total 542 square feet of ground cover.
The new ground cover for the house and the shed ground cover
would total 1,612 square feet. The ground cover ratio,
including the new construction, is 3 %.
The applicants seek a special permit to permit the
construction of the bathroom addition on the ground that this
extension of the structure into the 35 foot front yard setback
area (12 foot protrusion) is not more non - conforming than the
current house which protrudes 11 feet into the front yard
setback area.

Enclosed herewith for filing on behalf of my clients, Edmund
M. Reggie and Doris B. Reggie, is an application for Special
Permit relief to permit the construction of a bathroom addition
to Mr. and Mrs. Reggie's residence located at 18 Gardner Road,
Nantucket, Massachusetts 02554. I also enclose a plot plan
showing the existing structure, a plot plan showing the proposed
construction, a copy of a mortgage evidencing the fact that the
current structre existed on the lot prior to the effective date
of the zoning intensity requirements for the LUG -1 district, a
copy of the 1976 building permit application for an addition to
the premises, and a copy of Certificate of Title No. 10,413.
Also enclosed are my filing fee check in the sum of $150.00 made

The applicant seeks a Special Permit pursuant to Section 139 -33 of the by-law
to permit expansion of the existing structure so as to include a new bathroom.
The existing structure is twenty -three feet (23') from the front boundary. The
front yard setback requirement is thirty -five (35) feet The proposed bathroom
addition will not make this existing non-conformity distance non-conforming,
(See Addendum to application attached Hereto as Exhibit "A ")
EXHIBIT "A"
The applicants, Edmund M. Reggie and Doris B. Reggie, seek a
Special Permit pursuant to section 139 -33 of the By -Law to allow
for the addition of a bathroom on the easterly side of the
house. The existing house is 23 feet from the front boundary
line of the property and the front yard setback requirement in
this zoning district is 35 feet. The proposed bathroom addition
would also be 23 feet from the front yard boundary. Copies of
the plot plan showing the existing structure, plot plan showing
the proposed addition, and floor plans are attached hereto.
The property is situated at 18 Gardner Road, Shimmo,
Nantucket, Massachusetts and is shown as Lot 25 on Land Court
Plan 11461 -H filed with Certificate of Title No. 2020 at the
Nantucket Registry District. The existing dwelling on the
premises pre -dates the effective date of the Nantucket Zoning
By -Law as evidenced by a mortgage from predecessors in title
Robert W. Carrick and Doris F. Carrick to the Nantucket
Institution for Savings dated September 5, 1972 and recorded as
Document No. 13764 noted on Certificate of Title No. 6599 at
said Registry District. As of July, 1972, the property was
zoned residential and the intensity regulations for the
residential zoning district were 5,000 square feet minimum lot
size; no front yard setback requirement, 75 feet minimum
frontage and a ground cover ratio of 20 %. In March, 1973, the
property was upzoned to LUG -1 which provided for the current
intensity regulations, including the 35 foot front -yard setback
requirement. Thus, it is clear that the current dwelling
existed prior to the effective date (1973) of the current LUG -1
intensity regulations. On November 5, 1976, the Nantucket
Building Department issued Building Permit 495 -76 for
construction of a small 10 by 10 foot addition to the
northwesterly side of the house. This addition created no
zoning non - conformities. A copy of the building permit
application dated November 5, 1976 is annexed hereto.
The subject lot has an area of 47,300 square feet. The
proposed house on the lot is 35 feet from the southeasterly
boundary line, 128 feet from the rear boundary line and 87 feet
from the northwesterly boundary line. The current house, at its
closest point, is 23 feet away from the front boundary line.
The current house on the premises has a ground cover of 982
square feet and the shed on the premises has a ground cover of
88 square feet, for a total of 1,070 square feet. The proposed
additions to the house total 542 square feet of ground cover.
The new ground cover for the house and the shed ground cover
would total 1,612 square feet. The ground cover ratio,
including the new construction, is 3 %.
The applicants seek a special permit to permit the
construction of the bathroom addition on the ground that this
extension of the structure into the 35 foot front yard setback
area (12 foot protrusion) is not more non - conforming than the
current house which protrudes 11 feet into the front yard
setback area.
