Sherman, Chairman BOARD OF APPEALS BOARD OF APPEALS ,TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, MARCH 25, 1988 at 1:30 p.m. in the Town and County Building, Nantucket, made the following decision upon the Application of D AND B AUTO SERVICES, INC. (023 -88) Arrowhead Drive, Nantucket, MA 02554. 1. Applicant seeks a SPECIAL PERMIT under SECTIONS 139- 9B(3)(1) and -22E of the zoning by -law, allowing the following uses of its premises: 139 -9B(1) - rental or sale of bicycles, motorcycles, motor scooters, mopeds and similar motorized transports or means of conveyance (1, not Subsection I or c)as cited in error previously); and 139 -22E - auto rental agency. The premises are located at 12 ARROWHEAD DRIVE off Old South Road just north of the Nantucket Airport, Assessor's Parcel 69 -055, Land Court Plan 26984 -J, Lot 33, zoned RESIDENTIAL- COMMERCIAL -2. 2. Our findings are based upon the Application papers including site plan dated 1/11/88 (marked our Exhibit "A "), building and locus plans, and testimony and representations received at our hearing. 3. Applicant's lot is the sixth to the north off Old South Road (which borders the Nantucket Airport on its northerly boundary). To the east of the Arrowhead Drive intersection, about 500 feet away, is an automobile sales and services agency and to the west, a rental business for bicycles, mopeds and other items. The area is being developed for a mix of commercial and industrial uses, with some older residential use to the west along Nobadeer Farm Road. Lot area is 17,500 SF with only 5000 SF required by zoning. Across the rear of the lot where it abuts the Teasdale commercial subdivision to the west, a planting easement is shown with 10 -foot width. ,(023 -88) -2- 4. The proposed uses are to be provided for by a 3920 SF outside vehicle - parking storage area in the middle of the lot, with 10 -foot setbacks from either side lot line. The entry drive extending centrally to that storage area passes between a 144 SF one -story office building (to the south) and 900 SF 5 -space parking area for customers (to the north). Total area committed to commercial use will remain less than 5000 SF, thus below the threshold for a Section 139 -9B(4) Major Commercial Development ( "MCD "). TravalQd ways, parking and storage areas are to be surfaced with gravel or blueatone, to remain porous to rainfall. 5. The Planning Board's recommendation is favorable, and no oppo- sition heard. To assure further that the proposed uses are in harmony with the general purposes and intent of the zoning chapter, the following conditions are imposed: (1) The lot shall be developed in substantial conformance with the site plan Exhibit "A" except that the 5 -space parking area shall be relocated westward to be no closer than 20 feet from the front lot line (the Arrowhead Drive street line). (2) The vegetative screening required by Section 139- 18F(1) (b) shall be planted and maintained, e.g., inw madly of the street line and along the interior lot lines about the storage and 5 -space parking areas. (3) The lot portions outside the 4964 SF total of commercial use shall remain open area, in excess of the 20% required by Section 139 -16F. (4) If mopeds are offered for rental or sale, an adequate paved area for driver training shall be provided. 6. Applicant does not seek a Special Permit for servicing or refueling motorized vehicles. Hence, we are able to find, without further conditions, that the proposed uses will not be inj'violation of Section 139 -20A. (023 -88) -3- 7. We are particularly concerned with the prospect of moped rent- als and the attendant risk to their drivers of having serious accidents. However, the Town is seeking legislative authority to enact regulations which will limit unsafe practices. Applicant meanwhile could voluntarily impose conditions on moped rentals in the interest of safety. 8. Applicant may also offer truck rentals, e.g., by transferring this activity from its Sparks Avenue location, arguably as ancillary to the Special Permit uses on its Arrowhead Drive lot. 9. Having made the necessary findings, this Board by UNANIMOUS vote GRANTS to Applicant the requested SPECIAL PERMIT under SECTIONS 139 -9B (3)(1) and 139 -22E, Subject to the conditions noted above.
