APPEALS which has this day been filed with the Town
Clerk.
Any appeal from this action shall be made pursuant to
Section 17 of Chapter 40A of the General Laws, and

DECISION:
The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, FEBRUARY
5,1988 at 1:30 p.m. in the Town and County Building, Nantucket, made
the following decision upon the Application of THOMAS F. MARONEY (016 -88)
address 7 Pawnee Road, West Yarmouth, MA 02673.
1. Applicant seeks reversal of the 12/8/87 decisionof the Building
Commissioner denying to Applicant a Certificate of Occupancy for the
structure he built upon the premises. The grounds stated in the denial
were:
(1) the structure built was not the same as the one approved
under the Building Permit 3787 -84, and
(2) the structure built does not meet the zoning By -Laws,
Code,.Chapter 139. The appeal is taken pursuant to Sections 139 -31A and B.
Added to the notice of hearing is Applicant's (oral) request for a
variance from the Section 139 -16A limitation on ground cover to validate
ground cover as built. The premises are located at 25 SESAPANA ROAD,
Assessor's Parcel 68- 090,1Land Court Plan 14664 -C, Lot 28 (of "Nantucket
Court ") zoned LIMITED USE GENERAL -3.
2. Our findings are based upon the Application papers including
a copy of Building Permit 3787 -84, application for that permit with
plans ( "original plans "), plans of the house actually built ( "revised
plans "), and the Building Commissioner's decision letter of 12/8/87,
also viewings and correspondence, together with photoprints, representa-
tions and testimony received at our hearing.
3. We find that Applicant acquired the premises 2/10/86 from Roger
Roche. The latter had obtained Building Permit 3787 -84 dated 12/14/84
based upon a 3/30/84 applicatoniincluding the original plans. The data
entered on the BP application form includes the following:

• Total land area - 30,033 SF (LUG -3 min. lot size 120,000 SF)
• Frontage on street - 123.30 feet (LUG -3 min. 200 feet)
• Distance from property lines - front 40', left /right 40'
• Parking - 1 enclosed (one -car garage - single- story)
• Ground cover - principal dwelling - 1100 SF
garage - 264 SF
porch - 24 SF
1388 SF
This Building Permit was renewed 6/20/85 without modification of the
building design or footprint. The record is not clear whether such re-
newal was sufficient to validate 1986 -1987 construction.
4. On 12/15/85, R:o.che filed the revised plates with the Historic
District Commission ( "HDC ") and, on 1/15/86, obtained a Certificate of
Appropriateness 15510. If and when he intended to build according to the
revised plans, he was obligated to file that Certificate with the Building
Inspector!and request a corresponding modification of the Building Permit.
That he did not do. The original plans approved 3/27/84 by the HDC's
Certificate of Appropriateness 13,404 remained the basis for the Building
Permit.
5. Applicant's counsel represents that Roche on 6/24/86 filed an
"as- build" sewage disposal system plan showing a larger footprint than
the original such plan filed in support of the Building Permit. Counsel
also spoke of on -site inspections made at various times in connection
with construction underway. As the Building Commissioner explained,
such inspections concern the quality of work found on site, not whether
the correct building per Building Permit was being constructed.
6. According to counsel, Roche and perhaps his real estate agent,
represented to Applicant at the time of purchasing tra premises 2/10/86
that the house could be built in accordance with the revised plans.
We are not told whether Applicant had reason to realize that the plans
were revised relative to original plans or was made the victum of inten-
tional or negligent misrepresentation. In any event, Applicant, although
vocationally involved in the building trades, is portrayed here as
(016 -88) -3-
innocent, misled and not in a position to afford a loss, perhaps impru-
dent for buying without legal advice and accepting transfer of the
Building Permit without seeing plans in the file. -`
7. Applicant's Lot 28 is in the midst of the Milestone Realty
Trustisubdivision endorsed 12/18/75. Counsel alluded to "tortured"
litigation, but offered no evidence or account of how that lot (or other
lots irrthe subdivision) could be accorded status, as a result of liti-
gation or otherwise, as a "lot of record ". Zoning Section 139 -16A
plainly states in the first (*) Note that a lot of record with permissi-
ble ground cover of 1500 SF is
"Any lot lawfully laid out by plan ... duly
recorded ... pursuant to the Subdivision Control
Law before the effective date of this chapter ..."
Emphasis added, and references to recorded deed
and!ANR endorsement omitted.
Since Applicant's Lot 28 was not created until 12/19/75, more than 3
years after the mid -1972 effective date of Zoning, we can not find that
Lot 28 is a "lot of record ". Reference was made to a 1971 filing of a
subdivision plan but no relation established to Lot 28. Also spoken of
was a 1971 Pierce v. Board of Appeals suit but none is referenced in
this Application or the Building Permit application.
8. Counsel has not put in any evidence that Applicant's Lot 28
is entitled to a ground cover rAtio greater than the 3% allowed in the
LUG -3 District. For a lot size of 30,033 SF, the allowable ground cover
is 901 SF. On this record, we can only note that other houses in the
subdivision on similar lots exceed this ground cover, so there may indeed
be a valid basis for the 1388 SF allowed with Applicant's Building Permit.
But we can find no basis for, validating a greater ground cover, much
less the "revised plan" ground cover of about 2500 SF now built. Ground
cover is also referred to as 2180 SF, with no ready basis for us to
determine the accurate figure, the "GCR" entry on the Application form
having been left blank. But shown on it are "setbacks 10" feet, allowed
in LUG -3 only for "lots of record" and not conforming with the 40 -foot
setbacks entered on the Building Permit application.

y.Counsel noted that requiring a survey when setting a foundation
and before allowing further construction would avoid the error now
before us. We have previously noted that to be commendable. If relief is
not granted, counsel said that the completed building must be razed.
The Building Commissioner apparently would consider granting an occupan-
cy certificate if portions of the house (e.g., 672 SF of garage) were
removed to bring the house into conformity with zoning (and an HDC
Certificate of Appropriateness obtained for the scaled -down house).
10. In any event, we must find that Applicant is not entitled
to an occupancy permit. According to zoning By -Law Section 139- 28A(1),
such "permit shall not be issued until the premises, building or struc-
ture ... comply in all respects with this chapter" 139. Here, the lot
and its frontage are undersized, ground cover ratio exceeds the allowa-
ble maximum and perhaps side yard setbacks are violated. In addition,
Section 139 -26 and particularly 26J requires that "All work ... shall
conform to the approved applidation for which the permit has been issued
as well as the approved plot plan ". The violation of the latter, alone,
supporks denial of an occupancy permit and of this appeal.
11. If a request for variance were properly before us, we clearly
could not make the necessary findings. Any hardship is of Applicant's own
making, alone or with his predecessor's action. The lot, if buildable,
is not ;.otherwise charactgrized by circumstances having affect here and
not generally in LUG -3. Variance relief would be in direct and serious
derogation from the intensity regulations and the build +.to -plan require-
ment of Section 139 -26J. The Planning Board's recommendation was un-
favorable, also an abutter's, while another abutter favored relief.
12. Upon a first motion to uphold Applicant's appeal, this Board's
vote was UNANIMOUS in the NEGATIVE. Accordingly, relief is DENIED, and
the Building Commissioner's 12/8/87 refusal of an occupancy permit for
the premises is sustained.
13. Upon a second motion to grant the requested variance from
the maximum ground cover allowed by Section 139 -16A to validate the
"as- built" ground cover remaining after removal of the garage, the vote

was one (proponent Leddy) in favor and two (Sherman and Vollans) opposed.
Accordingly, relief by variance is DENIED.

EXHIBIT "B"
The applicant purchased the subject premises from Roger
Roche on February 10, 1986. Included as part of the sale was
the vacant land, all of Roger Roche's rights in the valid
Building Permit No. 3787 -84, and the obligation of Mr. Roche to
construct a four block foundation with piers prior to the
closing date. The Roche building permit application has a total
ground cover of 1,388 square feet. The Roche building permit
was issued on December 14, 1984 and renewed on June 20, 1985.
The original "as- built" sewage disposal system plan filed by
John J. Shugrue in support of the Roche building permit
application shows a proposed four bedroom dwelling and a
footprint for said dwelling in conformity with the building
permit application. On or about June 24, 1986, Mr. Roche filed
a revised "as- built" sewage disposal system plan which shows a
larger footprint for the dwelling. Prior to that date, Mr.
Roche filed a revised set of building plans with the Nantucket
Historic District Commission which also showed a larger house
and larger footprint. The Commission approved these plans on
January 15, 1986.
At the time the applicant purchased the property in
February, 1987,;it was represented to him by the Seller that he
would be able to build the house shown on the revised "as- built"
sewage disposal design plan and revised building plans. The
applicant was not represented by local counsel at the time he
purchased the property; he relied in good faith on the Seller's
representation that he would be able to build the house shown on
the revised "as- built" plan and design plans, and he did so.
The applicant's house has been constructed in accordance with
the revised "as- built" plan and revised design plans and he will
suffer a significant hardship if this Board fails to grant him a
Variance from the maximum allowable ground cover of 1,500 square
feet.
