DECISION:
The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, JANUARY
29, 1988 at 1:30 p.m. in the Town and County Building, Nantucket, made
the following Decision upon the Application of NANCY B. HORYN (008 -88)
address Box 628, Osterville, MA 02655.
1. Applicant seeks a SPECIAL PERMIT under SECTION 139 -33A of the
Zoining By -Law to alter and extend her existing single - family dwelling.
if granted, she will be able to raise a 1 -story section to 1 1/2 stories
with two east - facing doers to accommodate a master bedroom suite,
an existing second -floor bedroom bang converted to personal office (not
bedroom) use, and two first -floor bedrooms consolidated into one larger
bedroom. The premises are lcoated at ONE POCHICK STREET, SIASCONSET,
Assessor's Parcel 73.3.1 -020, Plan Book 15, Page 33, Lot A, zoned RESI-
DENTIAL OLD HISTORIC.
2. Our findings are based upon the Application papers including
6 sheets of drawings marked our Exhibit "A ", correspondence and photo -
prints, testimony and representations received at our hearing.
3. We find that Applicant's dwelling presently extends into the
5 -foot setback required by Section 139 -16C along the easterly side lot
line. The house now has a second -floor bedroom over the satherly living -
room portion and, in a middle single -story portion, 2 small bedrooms on
the west side. The middle and northerly portions, both single- story,
are to be raised to 1 1/2 stories to accommodate the master bedroom and
bath. With conversion of the existing second -story bedroom to personal
office use, the number of bedrooms is reduced from 3 to 2. The two
dormers to be added are well setback from the first -floor building line
but still close enough to the required easterly side yard to cause the
addition to increase the non - conforming nature of the dwelling structure.
Accordingly, the addition is not within the statutory exemption for a
single - family residential structure but requires Section 139 -33A relief

by Special Permit. Since the office is for personal use, not commercial
only the one off - street pang space for dwelling use is required.
4. From the many favorable letters sent to us by abutters and
neighbors, the favorable recommendation of the Planning Board, absense
of any objection, and the circumstances explained at the hearing, we
are able to make the requisite findings, - lamely, that the non - conforming
setback distance will not be made more non - conforming, the extension will
not be made substantially more detrimental to the neighborhood, and the
proposed addition and uses are in harmony with the general purpose and
intent of the zoning chapter. The house has been shown to pre -date zoning.
5. Accordingly, by UNANIMOUS vote, this Board GRANTS to Applicant
the requested SPECIAL PERMIT under SECTION 139 -33A for construction and
use substantially in accordance with Exhibit "A ".

residence, said to pre -date zoning and to be non - conforming in
extending into the 5 -foot side lot line setback required by

right of an existing second -floor space to be used as a per-

Applicant is seeking a special permit under Section 139 -33A, or�in the alternative

will combine two existing small bedrooms on the first floor into one large bedroom;
and will convert an existing bedroom on the second floor to an office; and will
add a new bedroom and bathroom. This will result in a decrease of bedrooms.
