Sherman, Chairman BOARD OF APPEALS BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, DECEM- BER 12, 1986 at 1:30 p.m. in the Town and County Building, Nantucket, made the following Decision upon the Application of SHARI N. ROSE, FOR HERSELF AND OWNER BUSKIN, INC. (145 -86) address Box 2197, Nantucket, MA 02554. 1. Applicant seeks a SPECIAL PERMIT under Zoning Code SECTIONS 139- 9B(3)(b), (c) and (g) to construct, and operateas uses permitted by exception, a three -bay garage accommodating one or more of tradesman's workshops and commercial storage (without repair or servicing) of motor vehicles and enclosed storage of goods, materials or other personal property (but not including harmful or hazardous fluids or substances). A favorable finding with respect to Section 139 -20 Prohibited Uses is asked. The tradesman's uses are not specified but could also include fabrication and assembly of component parts for off -site construction or use. The premises are located at 7 SALROS ROAD, Assessor's Parcel 67 -104, Plan Book 22, Page 63, Lot 8 in the RESIDENTIAL - COMMERCIAL -2 zone. 2. Our findings are based upon the Application papers, parking plan (our Exhibit "A ") and viewings, together with representations and testimony at our hearing. As we understand it, Applicant proposes to build a three -bay garage (not four as recited in the Application) with two apartments constituting the second floor. She intends to occupy one apart- ment and rent the other seasonally or year- round. Since the April 1986 Annual Town Meeting, two such second -floor apartments are allowed in the R -C -2 district with one being a secondary dwelling unit. See Section 139- 9A(15), as added by amendment, and Section 139- 7A(3). This Application concerns the commercial uses which are all on-the first floor. 3. Applicant's lot is near the east end of Salros Road with other unimproved lots except one across the road with a similar garage- apart- ment building of Kevin Kalman. Abutting Applicant's rear lot line is a (145 -86) -2- single - family residence fronting with other residences on Nobska Way. The concern of residential abutters is with screening, freedom from noise etc. barred by Section 139 -20A and barring any dormitory use of the premises. Otherwise, no opposition was heard and the Planning Board's recommendation was favorable., 4. The 8 spaces shown on Applicant's parking plan are sufficient to meet Section 139 -181 requirements by the following reckoning: 2 dwelling units 2 spaces 3 commercial uses 3 (1 space /900 SF) with up to 4 employees each 3 8 spaces Additional space is available adjacent the building to meet the loading facility requirement of Section 139 -19. 5. While not shown on the parking plan, screening is required by Section 139- 18F(1). Since uses remain unlgpwn on neighboring Salros Road lots, we condition relief here on Applicant establishing a screening along the length of her rear lot line, comprising an HDC- approved wooden barrier fence of at least 6 -foot height and east of the fence a row of tall evergreen bushes such as arborvitae selected and spaced effectively to visually obscure the fence when viewed from the easterly abutter's lot, after reaching a mature growth. 6. From the present record, we find no violation of Section 139 -20 in the proposed commercial uses but condition relief on continued absense of any violation, considering how close are the residential uses. We also bar any dormitory use. 7. With these conditions as to screening and no dormitory use or `(145 -86) -3- Section 139 -20 violations, we find that Applicant is entitled to the requested Special Permit as being in harmony with the general purposes and intent of the zoning chapter. 8. Accordingly, by UNANIMOUS vote, this Board GRANTS to Applicant the requested SPECIAL PERMIT to construct the proposed 3 -bay garage /apart- ment with off - street parking substantially conforming',to the Exhibit "A" plan of record, subject to the conditions noted above. The six foot fence required by Paragraph 5 of the Decision will not be approved by the i-iistoric District Commission. The number of shop spaces has been reduced from three (3) to one (1) thereby reducing the required parking spaces.
