NOTICE
A Public Hearing of the BOARD OF APPEALS will be held on
FRIDAY, NOVEMBER 21, 1986 at 1:30 p.m. in the TOWN AND COUNTY
BUILDING, FEDERAL AND BROAD STREETS, NANTUCKET, on the Applica-
tion of MARILYN P. SEICHTER (137 -86) seeking relief by SPECIAL
PERMIT and /or VARIANCE to allow her to construct a secondary
dwelling per SECTION 139 -7A(2) on the Lot, 12 or more feet from
the northeasterly lot line along_unconstructed Curve Street.
Applicant asks that Subsection (b) be interpreted not to require
such 12 feet to be easterly behind the "rear" of her existing
dwelling and that Sections 139 -16A and C not be interpreted to
require„a 30 -foot frontyard setback from Curve Street. The Lot's
frontage is on AURIGA STREET, (No. S), Assessor's Parcels 87 -128,
129 and 130,Lots 4 -6, Block 6, Surfside, and zoned RESIDENTIAL -2.

RIDER A
Applicant requests relief from Section 139 -16, Intensity
regulations, to permit the construction of a proposed second
dwelling five to ten feet from the lot line abutting Curve
Street and /or for a finding that Curve Street constitutes
the rear lot line for said property. Applicant requests
relief from Section 139 -7 A. (2) (b) to allow construction of a
proposed second dwelling twelve feet from the side building
line of the existing dwelling and /or for a finding that the since the
existing dwelling is constructed sideways on the lot that
the proposed second dwelling will, in fact be twelve feet
from the rear building line.
Property is a triangular shaped parcel bounded on two sides
by streets, one being Curve Street, an unconstructed way.
Current interpretation of the zoning by -law requires a front
yard set -back from each street line regardless of the
location of the house or front door.
Due to this interpretation of the zoning by -law and the
unique size and shape of the lot and the location and design
of the existing structure the Applicant is unable to comply
with the technical requirements of Section 139 -7 A. (2)
(b) and Section 139 -16. Therefore the Applicant requests
special permit and /or variance relief.
