DECISION:
The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, NOVEMBER
21, 1986 at 1:30 p.m. in the Town and County Building, Nantucket, made the
following Decision upon the Application of RONALD J. AND EVELYN SANTOS
(135 -86) address Masaquet Ave., Nantucket, MA 02554.
1. Applicant seeks a SPECIAL PERMIT pursuant to Zoning By -Law
SECTION 139 -2, specifically SUBSECTION (4)(f) of the definition of Cus-
tomary Home Occupations, to allow retail sales incidental to the occupa-
tion of inscribing quarter boards and related activities of his craft.
The premises are located at 8 MASAQUET AVENUE in Surfside, Assessor's
Parcel 80 -193, Lots 1 -40, Block 103, Section 1, Plan Book 1/20 -26, and
zoned LIMITED USE GENERAL -1.
2. Our findings are based upon the Application papers, correspond-
ence, and representations and testimony received at our hearing. We find
initially that Applicant has been inscribing quarter boards and light-
ship basket identity placques for some 7 years. His craft has been carried
on within his home, wither in his basement or in his garage.
3. Normally, a customer will make a pre- arranged visit at his home
to consider work samples before placing an order. When the wor X has been
completed, Applicant typically will deliver the results to the customer.
Since this activity is only part -time work and customer visits to the
premises are very limited, no adverse impact on the neighborhood is per-
ceived. To the extent any noise from sawing or inscribing may be generated
within the home, it evidently has not reached or troubled neighbors in
prior years.
4. The Planning Board's recommendation was favorable. Sole opposi-
tion was by neighbor's letter expressing concern with retail sales as a
possible precurser of a commercial situation in the neighborhood with
more people and traffic, and also with possbile growth to a full -blown

noisy shop. Our zoning code Section 139 -7A(4) permits customary home occu-
pations in residential neighborhoods without qualification. By definition
such use must be incidental and secondary to the dwelling use and free of
offensive noise, etc. The Special Permit here requested would allow inci-
dental retail sales limited to nomore than 100 SF area (or 10% of ground
cover, if less than 1000 SF). Product display and retail sales must be
within the dwelling, and no advertising signs on the premises.
5. With this answer to the neighbor's concerns, we find that the
relief sought would be in harmony with the general purpose and intent of
the zoning chapter.
6. Accordingly, by UNANIMOUS vote, this Board GRANTS to Applicant
the requested SPECIAL PERMIT under SECTION 139 -2, SUBSECTION (4)(f), of
the definition "Customary Home Occupation ".
