Any appeal from this action shall be made pursuant to Section 17 of Chapter 40A of the General Laws, and shall be.filed within twenty (20) days after this date. BOARD OF APPEALS TOWN OF NANTUCKET BOARD OF APPEALS NANTUCKET, MASSACHUSETTS 02554 In the matter of the Application of JOHN D. COHN and THOMAS B. COHN (131 -86), at a meeting of the BOARD OF APPEALS held at 1:30 P.M. on Monday, November 3, 1986, at the Town and County Building, Nantucket, the Board enters the following Decision and makes the following findings: 1. This is an application for a Variance granting relief from Nantucket Code §139 -16.A (Intensity Regulations - Front Yard Setback), and a Special Permit under §139 -33.A (Alteration and Reconstruction of Preexisting Nonconforming Structures). If granted, the Applicant would be permitted to maintain the existing buildings upon the premises, containing a total of three dwelling units, including a single -- family dwelling which was demolished and rebuilt in 1983. The premises are located at 12 LARRABEE LANE (Assessor's Parcel 55 -103), Lot 6, Plan Book 16, Page 31, and are zoned RESIDENTIAL -10. 2. The Board finds that the premises consist of a lot containing 20,484 square feet, in separate ownership from all adjoining land since a time prior to July, 1972, and that, in July, 1972, the premises contained a structure containing two dwelling units and another containing one dwelling unit. These structures have continued in existence and in the same use up to the present time, except that the single -- family structure sustained damage in a fire in 1983, and was rebuilt thereafter without any Page 1 of 3 1 zoning relief, nonwithstanding the fact that the reconstruction of the third dwelling unit was not permitted by the zoning by -law as a matter of right. 3. The reconstructed single - family residence is situated within nine feet of the front boundary of the premises along Larrabee Lane; the required front yard setback is ten feet. 4. This Board finds that, owing to circumstances relating to the shape of the land and structures thereon (consisting of the location of the existing structures upon the premises), which affect the premises but not affecting generally the zoning district in which they are located, literal enforcement of the provisions of the by -law would involve substantial hardship to the Applicants (consisting of the fact that the nonconforming structures are now in existence), and that desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of: the by -law (in that no change in conditions now existing upon the lot will result). The Board further finds that the variance relief requested is in harmony with the general purpose and intent of the Zoning Act and the Nantucket zoning by -law, for the same reasons. 5. This Board further finds that the alteration and reconstruction of the preexisting single- family dwelling, nonconforming in that it was one of three dwelling units upon the premises, where no more than two units are permitted under the S zoning by -law, will not be substantially more detrimental to the neighborhood than the preexisting nonconforming structure, ir.:that Page 2 of 3 r the intensity of use is not increased and the damaged structure was replaced by a new one of superior construction, and that the reconstructed structure is in harmony with the general purpose and intent of the by -law, in that it is a single - family dwelling located in a zone where single- family residential use is permitted. 6. For the reasons set forth, the BOARD OF APPEALS hereby GRANTS the Applicant relief from the Nantucket zoning by -law, §139 -16.A, and under §139 -33.A, permitting and approving the demolition and reconstruction of the single- family residence upon the Premises, as shown upon Exhibit A hereto, notwithstanding the fact that the structure as reconstructed violates the front yard setback requirements of the by -law, by a VARIANCE from §139• -16.A and a SPECIAL PERMIT under §139 -33.A, by UNANIMOUS VOTE.
