BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held on MONDAY, NOVEMBER 31 1986 at 1:30 p.m. in the Town and County Building, Nantucket, made the following Decision upon the Application of NANCY D. MINUS (130 -86) address 14 Darling Street, Nantucket, MA 02554. 1. Applicant seeks a SPECIAL PERMIT under Zoning Code SECTION 139 -33A to alter and extend a single - family residence non - conforming, e.g., as to ground cover ratio, by replacing an existing open deck with an enclosed porch. Alternatively, relief by VARIANCE from the SECITON 139 -16A limit of 50% ground cover ratio is sought. The premises are located at 14 DARLING STREET, Assessor's Parcel 42.3.2 -14, Lot 114 of Plan Book 22 at Page 18, and zoned RESIDENTIAL - OLD - HISTORIC. 2. Our findings are based upon the Application papers, viewings, correspondence and testimony received at our hearing. From these,, we understand that Applicant's dwelling long pre -dates zoning. Since acquir- ing the property in March, 1984, Applicant has undertaken various improve- ments not affected by zoning. She now proposes to replace an open 7' x 9 1/2" deck with an enclosed screen porch.-The proposed porch will in- corporate a portion of an existing room at the rear, the balance of that room being usable as a laundry. On plans received, the porch is the "sun - room". 3. Because the deck was not covered by a roof, it was excluded from the determination of ground cover ratio by the definition in Section 139 -2. To the extent it overlies the ground, i.e., about 67 SF, ground cover will correspondingly be increased. The new porch will to some extent be visable from both streets. 4. No objections were heard. Favorable letters were received includ- ing one from the most proximate abutter. The Planning Board's recommenda- tion was favorable. (130 -86) -2- 5. We find that existing non - conformities as to setback are not worsened and that the proposed extension and alteration will not be substantially more detrimental to the neighborhood. rather, it will be in harmony with the general purpose and intent of the zoning chapter. Relief by Special Permit is, therefore, available pursuant to Section 139 -33A. As we did not make the determinations necessary to Variance relief per Section 139 -32, in the alternative, such relief cannot here be granted, nor is it necessary to enable Applicant to proceed. 6. Accordingly, by UNANIMOUS vote, of this Board, Applicant is GRANTED the requested SPECIAL PERMIT pursuant to SECTION 139 -33A to con- vert the open deck to enclosed porch, alternative relief by VARIANCE being DENIED.
