WEST, as Trustees of WEST NOMINEE TRUST (129 -86), at a meeting of the BOARD OF APPEALS held at 1:30 P.M. on Monday, November 3, 1986, at the Town and County Building, Nantucket, the Board enters the following Decision and makes the following findings: 1. This is an application for a Special Permit under §139 -33.A (Expansion of Preexisting Nonconforming Structure) . The Applicants request relief to permit them to expand their existing one -car garage, accessory to their single- family dwelling, for use as a two -car garage with better alignment to the existing driveway, nothwithstanding the fact that the maximum ground cover ratio of 3% is already exceeded by the existing improvements upon the premises. The premises are located at 103 SANKATY ROAD (Assessor's Parcel 49 -4) , Plan Book 22, Page 7, and are zoned LIMITED USE GENERAL -3. 2. The applicants presented evidence at the hearing to show that their premises consist of a lot containing about 56,322 square feet, improved with a dwelling and one -car garage with total ground cover of about 2,323 square feet. The premises have been in separate ownership from any adjacent land, and the structures have been in existence since a time prior to the effective date of the zoning by -law in July, 1972. The maximum ground cover ratio permitted under the by -law is 3 %, or about 1,690 square Page 1 of 3 feet on this lot. Accordingly, we find that the present improvements upon the lot are nonconforming as to ground cover ratio, and that this nonconformity preexists the zoning by- lace. 3. The applicants represent that the existing one -car garage is so situated as to render it difficult or impossible for vehicular access and use, and that they propose to alter it by constructing an addition of about 200 square feet, to enable the garage to become a two -car garage, so aligned that both stalls will be readily accessed by automobiles and thus enabling the garaging of automobiles kept by the occupants of the premises. The existing living area on the second story of the garage will not be enlarged or altered, and will continue to consist of sleeping quarters and a bathroom, without kitchen or eating facilities. 4. This Board finds that the proposed addition will not be substantially more detrimental than the existing nonconforming structure to the neighborhood, and that it will be in harmony with -the general purpose and intent of the by -law, in that the consequent facilitation of placing cars in the garage will result in a public benefit, because the garaged vehicles will be less visible from adjoining property, and there will be no substantial effect upon the neighborhood. UL-1- 5. The relief hereby granted is upon the condition that the addition will not contain any kitchen or eating facilities. 6.
