DECISION:
In the matter of the Application of YOUSSEF RIZKALLAH (126 -86),
at a meeting of the BOARD OF APPEALS held at 1:30 P.M. on Monday,
November 3, 1986, at the Town and County Building, Nantucket, the
Board enters the following Decision and makes the fo I lowing findings:
1. This in an application for a Special Permit under the
Nantucket zoning by -law, §139 -33.A (Alteration and Extension of
Preexisting Nonconforming Use). The Applicant seeks relief to
permit him to alter his existing structure containing five dwelling
units, by structural changes to bring the building into conformity
with the Massachusetts State Building Code, including additions
containing secondary means of egress. The premises are located
at 1 GARDNER COURT (Assessor's Parcel 42.3.1 -186), Land Court
Plan 13467 -D, Lot 4, and are zoned RESIDENTIAL -OLD HISTORIC.
2. The Applicant has presented evidence to this Board that
his building contained three dwelling units in 1969, that remodeling
in 1969 reconfigured the space within the building and added two
additional dwelling units, and that the building has been used
continuously since 1969 as a five -unit apartment house use. On
the basis of this evidence, this Board finds that the present use
of the premises as a five -unit apartment building is protected as
a nonconforming -use, preexisting the 1972 adoption of the zoning
by -law.
3. In bringing tine building into conformity with the Building

Code, the Applicant represents that it will be necessary for him
to construct two small additions, each of which would constitute
an enclosed stairway; one would be located under an existing
deck. As an alteration and extension of the structure, now
containing a nonconforming use, the proposed changes require special
permit relief under by -law §139 -33.A. (We also note and find
that the existing structure is nonconforming in one respect as to
side yard setback requirements of the by -law; neither of the
proposed extension changes will be within the setbacks required
by the by -law.)
4. This Board finds that the proposed extension and
alteration of the building will not be substantially more detrimental
than the existing nonconforming use to the neighborhood where it
is situated, because no change in use will in fact occur and the
siting of the existing building and the proposed additions will
be minimally visible from adjoining property. Further, we find
that the proposed changes will be in harmony with the general
purpose and intent of the by -law, in that compliance with Building
Code provisions will result in a benefit to the public safety and
welfare.
5. The relief hereby granted is upon the condition that
the proposed additions will not create any additional dwelling
units or living area upon the premises, and that the additions
will be constructed in locations substantially in accordance with
the plan attached 'hereto as Exhibit A, showing the existing building
and the locations of "new stairs ".
6. For the reasons herein set forth, the BOARD OF APPEALS

hereby GRANTS the Applicant relief under the zoning by -law,
§139 -33.A, permitting the Applicant to construct stairway additions
to the existing building upon the premises, by a SPECIAL PERMIT,
by a UNANIMOUS VOTE.

A Public Hearing of the BOARD OF APPEALS will be held
on Monday, November 3, 1986, at 1:30 P.M., in the TOWN AND
COUNTY BUILDING, FEDERAL AND BROAD STREETS, NANTUCKET, on the
