In the matter of the Application of MARY KAY CONDON and E. MALCOLM CONDON (124 -86), at a meeting of the BOARD OF APPEALS held at 1:30 P.M. on Monday, November 3, 1986, at the Town and County Building, Nantucket, the Board enters the following Decision and makes the following findings: 1. This is an application for a Variance granting relief f: the Nantucket zoning by -law, §139 -18 (Off- Street Parking Requirements). The Applicants request permission for such relief in order to move a single- family dwelling now situated upon other land to their premises which contain an existing lodging house now containing six rental units. The premises are located at 109 ORANGE STREET (Assessor's Parcel 55 -361), Plan Book 13, Page 46, and are zoned RESIDENTIAL -1. 2. The Board finds that the premises now contain a lodging house with six rental units, which has been continuously used as such since a time prior to the effective date of the Nantucket zoning by -law in July, 1972. No parking spaces are provided upon the premises. Accordingly, the premises as they now exist are nonconforming both as to use and as to parking (the by -law requires eight spaces) , but these conditions pre -exist the by -law and accordingly are exempt from its provisions as they now exist. 3. The Applicants' proposed use of the premises for single - family residential purposes is a permitted use and would require Page 1 of 3 no relief from this Board. However, the addition of this use generates a requirement for one additional parking space, and we read §139 -18 to require the provision of the eight spaces that the lodging house use would necessitate if it were not now exempt, as well as the one additional space. The Applicants represent that this would be difficult or impossible upon the premises, granted their configuration and the location of the existing building, and that the existing use of their yard for gardens and lawns for use of guests and the owners would be impaired unduly. Further, they represent that, through their efforts to discourage guests from bringing automobiles to the island, very few parking spaces are in fact used or necessitated by their lodging house, nothwithstanding the requirements of the by -law. 4. This Board finds that, owing to circumstances relating to the shape of the lard and structures thereon (consisting of the existing location of the building upon the premises) which affect the premisesbut do not affect generally the zoning district in which they are located, literal enforcement of the provisions of the by -law would involve substantial hardship to the Applicants (consisting, again, of existing conditions upon the premises, and the fact that. full provision of parking as required is not reasonably feasible), and that desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the by -law (in that the provision of a single- family residence for use by the owners or managers of the lodging house is beneficial to the community in enabling closer supervision and management of Page 2 of 3 ',� ..... .. _... ir-� _ .'F:: Z *R .t .l... �.�, .... � .. .. � .. � "�4 ?'t'T.^.]I•l!*. r. .p .. .£..' .. :'ti- "iP ^.' .':R ^L°P �.; - '.'.. � s _.. _ "._ the lodging house, and the provision of parking spaces, where none now exist, will result in a net gain as a practical matter). The Board further finds that the proposed use is in harmony with the general purpose and intent of the Zoning Act and the Nantucket zoning by -law, for the same reasons. 5. The relief hereby granted is upon the following conditions: (a) The Applicants shall provide three parking spaces upon the premises, of which at least two shall comply with all applicable dimensional and design requirements of the by -law, and one may be non - complying in that it may be obstructed when a vehicle is parked on one of the qualifying spaces; (b) The new proposed dwelling unit shall be limited to use, as a single- family dwelling, by owners or managers of the lodging house upon the premises so long as it exists; and (c) No additional rental units shall be created in the lodging house. 6. For the reasons herein set forth, the BOARD OF APPEALS hereby GRANTS the Applicants relief from the zoning by -law, §139 -18, permitting the Applicants to place a single - family dwelling upon the premises notwithstanding the failure to provide all parking spaces required by uses upon the premises, upon the conditions herein set forth, by a VARIANCE Dated: Decemb-er 3 , 1986TH by a UNANIMOUS VOTE.
