Any appeal from this action shall be made pursuant to Section 17 of Chapter 40A of the General Laws, and shall be.filed within twenty (20) days after this date. BOARD OF APPEALS TOWN OF NANTUCKET BOARD OF APPEALS NANTUCKET, MASSACHUSETTS 02554 DECISION: In the matter of the Application of JEAN E. HERON, as Trustee of CENTURY HOUSE REALTY TRUST (123 -86), at a meeting of the BOARD OF APPEALS held at 1:30 P.M. on Monday, November 3, 1986, at the Town and County Building, Nantucket, the Board enters the following Decision and makes the following findings: 1. This is an application for a Special Permit granting relief under Nantucket zoning by -law §139 -33.A (Alteration of Preexisting Nonconforming Structure). The Applicant seeks permission to expand and relocate an existing single- family dwelling, nonconforming as to side yard setback, without increasing ground cover and reducing the extent of the nonconformity as to side yard setback. The premises are located at 10 CLIFF ROAD (Assessor's Parcel 42.4.4 -61) , Plan Book 22, Page 104, and are zoned RESIDENTIAL -OLD HISTORIC. 2. The premises consist of a lot containing 5,233 square feet, improved with a lodging house which pre- exists the zoning by -law and is a nonconforming use, and a one -story single- family cottage. The total ground cover of the existing stuctures is about 55 %, of which 450 square feet are taken up by the cottage; 50% is the maximum permitted by the by -law. The cottage is located partly within the required five -foot side yard setback, being as close as 0.3 foot at one point. 3. Elements of the existing building would be retained. The wall closest to the side boundary line would be moved, so that the closest point of the house will be about two feet from the boundary line. 4. The Applicant represents that the existing cottage is too small to meet her family needs, and that she and her husband propose to move into the renovated and enlarged cottage as their residence. No changes or expansion of the existing nonconforming guest house use are proposed. 5. This Board finds that the proposed alteration of the- single-family dwelling upon the premises will not be substantially more detrimental than the existing nonconforming structure and will be in harmony with the general purpose and intent of the by -law, in that the nonconformity in setback will actually be reduced, and the single- family use is a conforming use. 6. The relief granted hereby is upon the condition that, so long as the nonconforming guest house use shall continue to exist upon the premises, the single- family dwelling (as expanded and altered pursuant to the special permit granted hereby) shall !/. �4 be limited to the use of /owners, /managers and employees of the guest house. 7. For the reasons herein set forth, and subject to the above condition, the BOARD OF APPEALS hereby GRANTS the Applicant -i relief under the zoning by -law, §139 -33.A, permitting the Applicant l� f y to alter and enlarge her existing single- family dwelling without increasing the ground cover from the existing 450 square feet, by a SPECIAL PERMIT, by a UNANIMOUS VOTE.
