In the matter of the Application of DAVID H. FLEISCHER,
Trustee of R & R REALTY TRUST (122 -86), at a meeting of the
BOARD OF APPEALS held at 1:30 P . M . on Monday, November 3, 1986,
at the Town and County Building, Nantucket, the Board enters the
following Decision and makes the following findings:
1. This matter comes before the Board both as an appeal
from a decision of the Building Commissioner under the Nantucket
zoning by -law, §139 -31, and as an application for a Special
Permit under §139 -33.A (Alteration of Pre - existing Non - conforming
Use) and §139 -18.G (Relief from Parking Requirements - Core
District). The Applicant seeks to alter a retail store upon his
premises by inserting a demising wall to create an additional
store, without increasing the area of the building in retail
use. The premises are located at 18 FEDERAL STREET (Assessor's
.Parcel 42.3.1 -72), Lot 3, Plan Book 16, Page 32, and are zoned
RESIDENTIAL• - COMMERCIAL.
2. The applicant has been informed by the Building
Commissioner that he may not insert the proposed demising wall
without securing a Special Permit from this Board, in that the
insertion of the wall, creating two retail stores where two now
exist, would constitute an alteration of the pre - existing
nonconforming use. (Although the use of the premises for retail
stores is permitted in a Residential- Commercial district under
the by -law, the premises are nonconforming in that no parking

spaces are provided.) Applicant argues that, because no additional
retail space will be generated by the insertion of the wall, and
the by -law sets forth parking requirements on the basis of square
footage in a commercial or retail use without express reference
to each separate business location on the site, he may divide
his existing retail space into any number of separate retail
units without relief from the parking requirements established
by the by -law. We reject that contention, and rule that the
division of retail space into additional units constitutes an
"alteration" within the meaning of the by -law. Accordingly, to
the extent that the correspondence from the Building Department
attached to the application constitutes an order which may be
the subject of an appeal, we affirm the decision of the Building
Commissioner and rule that special permit relief is a prerequisite
for the Applicant's proposed action.
3. This Board finds that the premises contain a building
with two retail stores containing a total of about 1,488 square
feet of retail space, with about 527 square feet in the so"IKerly
store and about 961 square feet in the "orM-erly store; and with
one residential unit on the second floor. Those uses pre -exist
the 1972 adoption of the zoning by -law. At present, a total of
eleven parking spaces are required, determined as follows:

Thus, the required number of spaces would continue to stand at
eleven.
4. The Board further finds that the premises were formerly
used (more than three years ago) with three separate retail
spaces on the first floor, and are still configured with three
entrance doors upon the street level from Federal Street.
5. Because of the existing configuration of the premises,
and because no additional parking spaces are required from the
proposed change in use under the reckoning process mandated by
the by -law, this Board finds that the proposed alteration will
not be substantially more detrimental than the existing
nonconforming use (nonconforming as to parking) to the neighborhood.
Accordingly, the proposed alteration would be in harmony with
the general purpose and intent of the by -law.
6. For the reasons herein set forth, the BOARD OF APPEALS
hereby GRANTS the Applicant a SPECIAL PERMIT under §139 -33.A and
§139 -18.G of the Nantucket zoning by -law, to permit the proposed
alteration of the premises as herein described, by a UNANIMOUS
VOTE.
