Sherman, Chairman BOARD OF APPEALS BOAt'\G ()IF ^,i i'i`Af,S TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held on TUESDAY, OCTOBER 7, 1986 at 1:30 p.m. in the Town and County Building, Nantucket, made the following Decision upon the Application of WILLIAM B. AND CLAIRE CARDELLI (117 -86) address 55 Meadow View Drive, Nantucket, MA 02554. 1. Applicants seek a SPECIAL PERMIT under Zoning Code SECTION 139 77C to install an Accessory Apartment in their single- family resi- dence. The premises are located at 10 DOC RYDER DRIVE, Assessor's Parcel 066 -218, Lot 116 of Land Court Plan 28933 -N in the RESIDENTIAL - COMMERCIAL-2 zoning district. 2. Our findings are based upon the Application papers and testi- mony and representations at our hearing. We understand that Applicants' 0.45 acre lot is typical of its neighborhood. Ground cover of 1900 SF is spoken of, leaving adequate provision for two off - street parking spaces. Applicants would comply with all of the conditions set forth in Section 139 -7C(2) including execution and recordation of the required year -round occupancy covenant. 3. Misgivings with Applicants' proposed installation of an Accessory Apartment are based on circumstances similar to those on which our recent negative decision in 106 -86 was based. The lot size of 0.45 conforming to the 20,000 SF zoning minimum is one -half that required in the recent Board of Health regulation for one dwelling unit and associated septic system. We recognize that lots of record, such as the locus here, are excepted from the regulation. Also, we are not empowered to enforce Board of Health regulations. Nonetheless, a stated purpose of our Zoning Code is to promote health, uncontaminated water being vital to that end, Section 139 -1. Also we are told that 3M, developers of Applicants' subdivision, undertook with the Nantucket Planning Board to restrict these lots to have onlij one dwelling unit. An Accessory Apartment, by definition, is a second dwelling unit. If (117 -86) -2- the Planning Board had given a negative recommendation we would feel constrained. 4. Unlike our 106 -86, however, in this case no opposition was heard. The Planning Board's recommendation was favorable. 5. Accordingly, we find here that the relief sought (structure and use) is in harmony with the general purposes and intent of the zoning chapter. 6. By UNANIMOUS vote of this Board, the requested SPECIAL PERMIT is GRANTED to Applicants for the installation and use of the Accessory Apartment in conformity with the provisions of SECTION 139- 7C(2).
