DECISION:
The BOARD OF APPEALS,.at a Public Hearing held on TUESDAY,
OCTOBER 7, 1986 at 1:30 p.m. in the Town and County Building, Nan-
tucket, made the following Decision upon the Application of MURIEL
MARCUS (115 -86) address 1500 Palisades Avenue, Fort Lee, NJ 07024.
1. Applicant seeks a SPECIAL PERMIT under Zoning Code SECTION
139 -16C to cure an existing 4 -inch non - conformity with respect to rear
lot line setback. If granted by a reduction of the required 10 -foot
setback to 5 feet, the existing house (southwesterly corner) may remain
free of zoning violation, and the existing deck brought back to a 5-
foot setback from the rear lot line. The premises are located at 50
STARBUCK ROAD, MADAKET, Assessor's Parcel 60 -029, Lot 287 of Land Court
Plan 3092 -19, Cert. 8406, in the RESIDENTIAL -2 zoning district.
2. Our findings are based upon the Application papers and pre-
sentations at our hearing. We are told that the setback intrusion arose
with 1983 construction of the addition. The foundation is said to be
fully outside the 10 -foot setback, whereas wooden siding extends the
prohibited 4 inches into the setback. The deck was apparently constructed
oblivious of the zoning requirement. No question is raised of con-
struction without conformance with a duly issued building permit.
3. The Planning Board's recommendation was favorable, and no
opposition was heard. The Code provides for relief by Special Permit
without meeting the more severe requisites for variance relief. We are
here able to find that the Special Permit relief would be in harmony
with the purposes and intent of the zoning chapter.
4. Accordinly, by UNANIMOUS vote, this Board GRANTS to Applicant
the requested SPECIAL PERMIT under SECTION 139 -16C to maintain the
existing house as cited and the existing deck to the extent it does not
extend within a 5 -foot rear yard setback.

TUESDAY, OCTOBER 7, 1986 at 1:30 p.m. in the TOWN AND COUNTY BUILDING,
FEDERAL AND BROAD STREETS, NANTUCKET, on the Application of MURIEL
B. MARCUS (115 -86) seeking a SPECIAL PERMIT under SECTION 139 -16C
of the Zoning By -Law. If granted, the Applicant would be allowed to
reduce the side and rear lot line setback from 10 to 5 feet to cure
a 4 -inch intrusion into the setback by a rear building corner and
thus remove a defect in marketability. The premises are located at
50 STARBUCK ROAD, MADAKET, Assessor's Parcel 60 -029 (Lot 287 of
Land Court Plan 3092 -19, Cert. 8406) and zoned RESIDENTIAL -2.
