DECISION:
The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, OCTO-
BER 39 1986 at 1:30 p.m. in the Town and County Building, Nantucket,
made the following Decision on the Application of Michelle Wall
(112 -86) address 12 Friendship Lane, Nantucket, MA 02554.
1. Applicant seeks a SPECIAL PERMIT pursuant to SECTION 139 -16C
of the Zoning Code to cure a zoning non - conformity with respect to the
required 10 -foot rear lot line setback, the existence of a 9.1 -foot
setback of her single - family dwelling at its northeast corner having
been disclosed by a recent mortgage plot plan survey. The premises are
located at 12 FRIENDSHIP LANE, Assessor's Parcel 86 -269 (Lot 75 of
Lankaurt Plan 35397 -G, under listing of Michelle Wall Cuddy), and in
the zoning district RESIDENTIAL -2. (In the alternative, she asked a
VARIANCE from the rear lot line setback requirement of SECTION 139 -16C.)
2. Our= findings-are- based- -upon 'the= _Application - papers including
a copy of her mortgage plot plan dated September 8, 1986, and testimony
and representations at our hearing. The plan shows the 9.1 foot dis-
tance as the nearest point between dwelling and rear lot line. Deck
structure extending to the lot line has, or will be removed. No abut-
ter's house or structure is proximate the rear lot line, we understand.
3. No evidence was received that siting of the house or the
batter boards was carelessly or intentionally too close to the line.
The lot is ample for siting closer to the front. A severe financial
and personal hardship would be entailed to eliminate the 0.9 feet of
house corner extension into the required rear yard. The Code at Section
139 -16C facilitates relief by Special Per -J empowering this Board to
reduce the required setback to 5 feet in this R -2 district.

4. The Planning Board's recommendation was favorable and no
opposition was heard. Without need to find the uniqueness required for
a variance, we are able to affirm that relief by Special Permit would
be in harmony with the purpose and intent of the zoning chapter.
5. Accordingly, by UNANIMOUS vote, this Board GRANTS to Applicant
the requested SPECIAL PERMIT under SECTION 139 -16C reducing the rear
lot line setback to 5 feet to the extent and only to the extent neces-
sary to free from any zoning non - conformity, Applicant's residence
as presently sited. (Correspondingly, the alternative request for
relief by Variance is denied as unneccessary in view of the relief
granted.)

A Public Hearing of the BOARD OF APPEALS will be held on
FRIDAY, OCTOBER 3, 1986 at 1:30 p.m. in the TOWN AND COUNTY BUILDING,
FEDERAL AND BROAD STREETS, NANTUCKET, on the Application of MICHELLE
WALL (112 -86) seeking a SPECIAL PERMIT or in the alternative a
VARIANCE under SECTION 139 -16C (rear and side line setbacks) of the
Zoning By -Law. If granted, the Applicant would be allowed to cure a
a defect for purposes of mortgagability as the dwelling on this
property is 9.1 feet from the rear and side line setback instead of
the required 10 feet. The premises are located at 12 FRIENDSHIP
LANE, Assessor's Parcel 0066 -269 and zoned RESIDENTIAL -2.
