Sherman, Chairman BOARD OF APPEALS BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held on TUESDAY, OCTOBER 71 1986 at 1:30 p.m. in the Town and County Building, Nan- tucket, made the following Decision upon the Application o� MICHAEL ANGELASTRO FOR HIMSELF AS CONTRACT PURCHASER AND ARNOLD TEASDALE, OWNER (111 -86) address 35 Old South Road, Nantucket, MA 02554. 1. Applicant seeks a SPECIAL PERMIT under Zoning Code SECTIONS 139- 9B(3)(a), (b), (c) and (g), the latter limited to a garage for motor vehicle storage without repair or servicing. He would undertake carpentry, e.g., cabinet making on -site for off - premises assembly and installation, and associated storage of materials and contractor's vehicle, as appro- priate to a building contractor's business. The required finding under Section 139 -20A is asked. The premises are located at TEASDALE COURT, Lot 2 of Land Court Plan 14342 -F, Lot 8 of Planning Board File 2870, in the RESIDENTIAL- COMMERCIAL -2 zoning district. 2. Our findings are based upon the Application papers and testi- mony and representations at our hearing. We are told that the lot will soon be released. It is in a neighborhood appropriate for the proposed further commercial activities. Applicant will provide the parking required in Section 139 -18 on the site. We perceive no likelihood of a Section 139 -20A violation by noise, fumes or the like. 3. For these reasons, we find that the requested relief would be in harmony with the purposes and intent of the zoning chapter. The Planning Board's recommendation was favorable, and no opposition was heard. 4. Accordingly, by UNANIMOUS vote, this Board GRANTS to Applicant the requested SPECIAL PERMIT under SECTION 139- 9B(3)(a), (b), (c) and (g), the latter limited as noted. In the past the Building Department has issued numerous permits to permit a building to be used by local tradespeople for storage of plumbing, electrical, and building materials as well as workshop space for tradespeople. It is now the interpretation of the Building Department that these uses require a Special Permit under 139 -9 (B). It is not clear if a carpenter using such space for constructing cabinets to be installed in a kitchen off site is light manufacturing or fabrication and assembly of component parts for off site assembly. Hence the relief sought is for both sub sections. In addition, a tradesperson storing materials in said building would also need relief from subsection (b) which is also sought. Relief from subsection (g) is also sought in the event that a contractor wants to store a vehicle in said building. It is clearly in the best interest of the Town to have these activities carried on in a Commercial zone rather than a Residential zone which is permitted under Customary Home Occupations. The proposed use(s) will not be in violation of section 139 -20 and are allowed by Special Permit in the RC zone.
