Sherman, Chairman BOARD OF APPEALS BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held on TUESDAY, OCTOBER 7, 1986 at 1:30 p.m. in the Town and County Building, Nan- tucket, made the following Decision upon the Application of MARILYN AND WALTER RABETZ (109 -86) address 41 Batchelder Road, Windsor, CT 06095. 1. Applicants seek a SPECIAL PERMIT under Zoning Code SECTION 139 -33A or a VARIANCE Under SECTION 139 -32 for premises which are non- conforming as to frontage (28.5 feet, not 75 feet) and as to regularity formula. Applicants would alter and extend an accessory building, with- out further or increased zoning non - conformity, to provide an artist's studio sized to accommodate their work. The premises are located at 25 HUMMOCK POND ROAD, Assessor's Parcel 56 -8, Lot 9 of Plan 19 at Page 13, and in the RESIDENTIAL -2 zoning district. 2. Our findings are based upon the Application papers, corres- pondence and testimony at our hearing. It appears that Applicants' Lot 9 was originally part of a parcel of land owned by Mrs. Clara McGrady. In 1975 Charles F. Davis, purchaser of that parcel of land, subdivided it into lots variously lacking adequate area and frontage to meet then zoning requirements. These shortcomings were noted on the Plan by legend of the Planning Board at the time of its 1975 endorsement "Appro- val Not Required ". Subsequently, the requirements of present Section 139 -16D were enacted, causing the premises to be additionally noncon- forming and "pre -exist tig'lwith respect to regularity factor. 3. Applicants have begun interior renovation of the garage on the premises to provide themselves with an &rtist's studio. They state that they now wish to alter and extend that building without further or increased zoning non - conformity, e.g., as to setbacks, ground cover or use. Accordingly, to the extent they will be carrying on a "customary home occupation" per Section 139- 7A(4),they will necessarily stay within (109 -86) -2- its bounds defined in Section 139 -21 with use permit from the Building Inspector. 4. This small 10' x 10' addition to the building (with deck) has neighborhood approval indicated by 9/25/86 letter of Robert Feder and testimony of Mrs. McGrady. The Planning Board's recommendati -en was fav- orable. The lot, of 28,638 SF, is above the 20,000 SF minimum, and spacings are ample. 5. We find that the proposed alteration and extension will not be substantially more detrimental to the neighborhood but in harmony with the intent and purpose of the zoning chapter. 6. Accordingly, by UNANIMOUS vote, this Board GRANTS to Applicants the requested SPECIAL PERMIT under SECTION 139 -33A (but denies the alternative request for relief by Variance for lack of requisite findings).
