BENNETT (108 -86) , at a meeting of the BOARD OF APPEALS, held at 1:30 P.M. on Friday, October 3, 1986, at the Town and County Building, Nantucket, the Board enters the following Decision and makes the following findings: 1. This is an application for a SPECIAL PERMIT granting relief under Nantucket Code §139 -33.A (Structural Changes and Alteration of Pre- existing Nonconforming Structure). If granted, the Applicants would be permitted to make structural alterations in the rehabilitation of the building upon the premises, by demolishing and reconstructing an existing portion of the structure, within five feet of the side lot line, including addition of a second story to a portion thereof, without changing the existing building line. The premises are located at 21 ORANGE STREET, Lot 4, Deed Book 31, Page 440 (Assessor's Parcel 42. 3.2 -10), and are zoned RESIDENTIAL -OLD HISTORIC. 2. Based upon the application and the materials and testimony provided at the public hearing, the Board finds that its premises contain one of several antique "row houses ", each of which shares a party wall with its neighbor or neighbors. The easterly portion of the house on the premises, toward Orange Street, is two - story, and shares a party wall on the north and south; the westerly or rear portion is one -story and shares a wall only with the building Page 1 of 2 C to the north. The applicant is engaged in rehabilitation and restoration of the house, and proposes to demolish the westerly portion of the house and to rebuild it in its present configuration (actually eliminating a small portion at the extreme westerly end) and by constructing a small second -story addition adjacent to the main portion of the building, containing a bathroom. The second -story addition will be adjacent and substantially identical to a similar addition on the adjacent property to the north. 3. The Board finds that the existing structure upon the premises pre - exists the Nantucket zoning by -law, and that the configuration of the buildings upon the premises and adjacent parcels results in substantially no effect upon neighboring property from the proposed change. 4. Accordingly, the Board expressly finds that the proposed alterations in the premises will not be substantially more detrimental than the existing nonconforming use to the neighborhood. The Board further finds that the proposed changes are in harmony with the general purpose and intent of the by -law. 5.
