Sherman, Chairman BOARD OF APPEALS BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, SEPTEM- BER 51 1986 at 1:30 p.m. in the Town and County Building, Nantucket, made the following Decision upon the Application of BRENT AND JULIE YOUNG (096 -86) of Box 474, Nantucket, MA 02554. 1. Applicants seek a SPECIAL 139 -18E to provide off the premises connection with their proposed comm, The premises are located at0 CHERRY Lot 2, Plan Book 22 at Page 97, and Parcel 55 -377 in common ownership. PERMIT under Zoning By -Law SECTION the two parking spaces required in arcial retail use in a 368 SF building. STREET Assessor's Parcel 55- 377.1, zoned RESIDENTIAL - COMMERCIAL, also 2. Our findings are based upon the Application papers, Assessor's records, and viewings and site plan, testimony and representations re- ceived at our hearing. As we understand it, the building on the premises was a residential cottage when owned by Applicants' predecessors in common with their residence on Parcel 55 -377 (117 Orange Street). Follow- ing art ANR subdivision into the present two lots, each slightly above the 5000 SF minimum area, Parcel 55 -377 was bought by Applicants and con- verted to commercial use as the Orange Street Video with 11 associated off - street parking spaces, 10 being required for that use. The other lot also acquired by Applicants lacked the three off - street parking spaces required by Section 139 -18, two cannot readily be provided on -site. 3. Applicants propose to lease parking spaces from Frank and Grace Rose, owners of Parcel 55 -364 located to the north just across Williams Street, to the rear of the premises. On that parcel, the Roses have a retail store Cumberland Farms at 115 Orange Street. Diagonal parking against the south side of the store is ac3ively used by patrons who back directly into Williams Street. Immediately to the west (rear of the store), an area is used for store deliveries and occasional patron parking. I. (096 -86) -2- At the west end of the parcel is an area approximately 109' x 113' area which Applicants would lease including a 20' x 54' area for 6 park- ing spaces, layed out in accordance with Section 139 -18 and good planning practice. This area is said to be in the Residential - Commercial district so that the proposed off -site parking might properly be permitted. These areas are not paved or otherwise surfaced. We are told that parking spaces required for the Cumberland Farms use do not exceed 6 and that these (with the required off - street loading area) can be provided in a legally acceptable way by the Roses outside the area to be leased to Applicants. 4. We condition our grant of relief on Applicants obtaining a lease of that proposed westerly parking area without depriving Cumberland Farms of the noted area it legally requires. A further condition is imposed that the leased parking area, laid out as above stated, have the 6 spaces delineated by split -rail fencing identified by HDC- approved signage, with the area maintained , graded and level. Special Permit relief under Section 139 -18E properly runs only for the term of Appli- cants' lease, recorded against Assessor's Parcel 55 -364 Book 129, Page 61, and recorded extensions thereof. 5. With these conditions and absent any opposition, we find that the requested SPECIAL PERMIT would be in harmony with the general purpose and intent of the zoning chapter. Retail use of the 368 SF building would necessarily be limited to that for which only the two off- siteAauthorized and required added to the one space on -site associated with the Orange Street Video. 6.
