DECISION:
The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, SEPTEM-
BER 19, 1986 at 1:30 p.m. in the Town and County Building, Nantucket, made
the following Decision on the Application of JOHN M. AND ELLIN R. LEGGETT
(094 -86) of 897 E. Beau Street, Washington, PA 15301.
1. Applicants seek a SPECIAL PERMIT under Zoning By -Law SECTION
139 -33A to alter and extend their existing, single - family dwelling by
adding approximately 288 SF to the rear of the non - conforming structure.
The premises are located at 262 MADAKET ROAD, Assessor's Parcels 059!4-
269 and-270,Lots 241 and 242, Plan 3092 -13, and zoned RESIDENTIAL -2.
2. Our findings are based upon the Application papers, including
floor plan marked Exhibit A, and testimony and representations at our
hearing. Based upon the latter, we find that the structure pre -dated
zoning. Non - conformity is found in the intrusion of the attached garage
into the rear yard setback within 2 feet of the lot line. Section 139 -16C
specifies a 10 -foot rear -yard setback but empowers this Board, by Special
Permit, to reduce the required distance to 5 feet.
3. Applicants propose a 288 SF addition at the rear of their
dwelling for kitchen and dining space. The closest it will come to the
rear lot line is 5 feet; hence, it will not be more non - conforming than
the pre- existing structure. We are told that the allowable ground cover
ratio will not be exceeded. On Exhibit A, the extended "footprint" of
the dwelling is shown.
4. No opposition was heard and no detriment to the neighborhood
is perceived. To the rear (southwest) of Applicants' lot is a cottage,
time - shared we are told, spaced by a stand of trees. The Planning Board's
recommendation was favorable.

5. Accordingly, we make the findings required for the requested
Section 139 -33A Special Permit, specifically, that the proposed alteration
and extension per Exhibit A will not be substantially more detrimental to
the neighborhood than the existing non - conforming structure, nor will the
extension be more non - conforming. Given the availability of relief by
Section 139 -16C Special Permit reducing the required rear -yard setback
to 5 feet, we further find that the requested relief is in harmony
with the general purpose and intent of the zoning chapter.
6. By UNANIMOUS vote, this Board GRANTS to Applicants the requested
SPECIAL PERMIT under SECTION 139 -33A to alter and extend their dwelling
in substantial accordance with Exhibit A of record.
