Sherman, Chairman BOARD OF APPEALS BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, SEPTEM- BER 5, 1986 at 1:30 p.m. in the Town and County Building, Nantucket, made the following Decision on the Application of ELMA GUTTENBERG (090 -86) of 521 Brownstone Ridge, Meriden, CT 06450. 1. Applicant seeks a SPECIAL PERMIT under Zoning By -law SECTION 139 -33A to alter and expand an existing single - family residence by additions to the northwest side and to the rear. The premises are non- conforming as the- dwelling front extends into the required 30 -foot front yard setback and the lot size is less than the 20,000 SF minimum lot size. In the alternative, a VARIANCE is sought from the SECTION 139 -16A front - yard requirement to allow the northwesterly addition.The premises are located at 1 H STREET, MADAKET, Assessor's Parcel 60.1.2 -65 (Lot 81, Land Court Plan 3092 -S, Cert. 10678) and zoned RESIDENTIAL -2. 2. Our findings are based upon the Application papers including site sketch marked Exhibit A at our hearing, viewing, and representations by Applicant'a agent at our hearing. From the latter, we find that the existing building, marked "EX" on Exhibit A, pre -dated zoning. Thus, Section 139 -33A is applicable to the proposed alteration and expansion (marked "AD" thereon) of this pre- existing, non - conforming dwelling. 3. The proposed northwesterly addition, to provide living room space, balances the southeasterly portion, notably in the same 19 -foot setback from the H Street front lot line. Since the added portion would not be more non - conforming in its intrusion into the required front yard, a Special Permit can be granted. The addition to the rear is itself conforming. 4. No opposition was heard and no adverse impact on the neighbor- hood was perceived. The Planning Board's recommendation was favorable. Accordingly, we find that the alterations and extensions proposed per (090 -86) -2- Exhibit A is not substantially more detrimental to the neighborhood than the pre- existing non - conformity, but in harmony with the general purpose and intent of the zoning chapter. 5. Variance relief is accordingly unnecessary and would, in any event, be hard to support with proper findings. Accordingly, it is DENIED. 6. By UNANIMOUS vote, this Board GRANTS to Applicant the requested SPECIAL PERMIT under SECTION 139 -33A for alteration and extension sub- stantially in accordance with exhibit A of record.
