Sherman, Chairamn BOARD OF APPEALS TOWN OF NANTUCKET BOARD OF APPEALS NANTUCKET, MASSACHUSETTS 02554 DECISION: In the matter of the application of PRESERVATION INSTITUTE: NANTUCKET, INC., and SHERBURNE HALL CONDOMINIUM TRUST (086 -86) , at a meeting of the BOARD OF APPEALS, held at 1:30 P.M. on Friday, September 5, 1986, at the Town and County Building, Nantucket, the Board enters the following Decision and makes the following findings: 1. This is an application for a SPECIAL PERMIT granting relief under Nantucket Code §139 -33.A (Structural Changes and Alteration of Pre - existing Nonconforming Structure) and §139 -18.A and G (Parking Requirements - Change of Use, Core and Resident Parking Permit District). If granted, the Applicants would be permitted to make structural alterations in the rehabilitation of the building upon the premises, without change in use except for change of second floor from meeting hall to classroom, academic offices and lecture hall. The premises are located at 7 -19 CENTER STREET (Assessor's Parcel 42.3.1 -203) , Land Court Plan 14210 -C -1, and are zoned RESIDENTIAL - COMMERCIAL. 2. Based upon the application and the materials and testimony presented at the public hearing, the Board finds that the proposed structural alteration of the building upon the premises will have no effect upon the nature or intensity of use of the premises, which now contain six retail units with direct street entrances, together with appurtenant storage areas. The Applicants' proposal is limited to the repair and rehabilitation, with necessary structural alterations, to the building. No additional retail space, nor additional units, will be created by the proposed changes. 3. As to the proposed change in use of the second floor space, from meeting room space to academic use by Preservation Institute: Nantucket, Inc. ( "PIN "), we find that the proposed use will entail less intense overall use of the building than the previous meeting room use. The by -law specifies no parking requirements for academic or non - profit use, and in any event the number of parking spaces required will be significantly less than that required (but substantially not provided) for the previous use. The proposed use by a non - profit organization engaged in academic research projects relating to Nantucket's historic architecture is a particularly appropriate one for this building, itself a historic landmark in the downtown area. 4. This Board expressly finds that the proposed alterations in the premises will not be substantially more detrimental than the existing nonconforming use to the neighborhood, and in fact will constitute a significant improvement to the area. The Board further finds that the proposed changes are in harmony with the -1- general purpose and intent of the by -law, in that their effect will be an improvement to the immediate area and will benefit the Town and public generally. 5. The relief hereby granted is conditioned upon the improvements being constructed substantially in accordance with the plans submitted to the Board, reduced copies of which are attached hereto as Exhibit A. 6. For the reasons and upon the conditions set forth, the BOARD OF APPEALS hereby GRANTS the Applicants relief under zoning by -law, Nantucket Code, § §139 -33.A and 139 -18 -A and G, permitting the alteration of their building in accordance with the plans submitted, and the change of use of the former meeting hall for academic purposes as requested; by a SPECIAL PERMIT, by a UNANIMOUS VOTE.
