Enclosed is the decision of the Board of Appeals which has this
say been filed with the Nantucket Town Clerk.
An appeal from this decision may be taken pursuant to Section 17
of Chapter 40A, Massachusetts General Laws. Any action appealing
the decision must be brought by filing a complaint in court
within twenty (20) days after this date. Notice of the action
with a copy of the complaint and certified copy of the decision
must be given to the Town Clerk so as to be received within such
twenty (20) days.

CLARIFICATION OF DECISION
At a Public Meeting of the BOARD OF APPEALS duly called and
held on October 13, 1988, at 1:00 P.M. at the Town and County
Building, Nantucket, the Board considered the request of PAUL B.
WAINE and DALE W. WAINE, Trustees of PEARL STREET REALTY TRUST
for clarification of the Decision in Case No. 085 -86.
This Special Permit authorized retail use on the first and
second stories of the structure to be constructed pursuant thereto.
The building has now been completed, and the Applicants request
clarification from this Board that the permitted retail uses on
the first and second floors also include the right to use these
areas for office use in the alternative.
Both office and retail uses are permitted as a matter of
right in this Residential - Commercial district. Retail use entails
more extensive parking requirements under the By -law, in that
spaces are required for employees in retail use but not in office
use; otherwise, the requirements (one space for each 200 square
feet of gross floor area) are identical.
In response to the frequently expressed concern that real
estate offices place a significantly greater parking burden than
other office uses, the Applicants have volunteered the condition,
which we //accept and adopt, that in the event that any real estate
brokerr occupant of the Premises shall waive eu.1 entitlement to
parking permits otherwise available to brokers in the Core and
Resident Parking Permit Districts.
Subject to this limitation, we find that our Decision in
085 -86 permits, in addition to retail uses as set forth therein,
use of the first and second floor of the building for office use.

After a Public Hearing of the BOARD OF APPEALS held on
AUGUST 15, 1986, at 1:30 P.M., at the Town and County Building,
Nantucket, upon the Application of PAUL B. WAINE and DALE W.
WAINE, Trustees of PEARL STREET REALTY TRUST (085 -86), the Board
makes the following findings and enters the following decision:
1. This is an application for a SPECIAL PERMIT under the
Nantucket Zoning By -Law, §139 -33.A (Alteration and extension of
pre- existing non - conforming structure) and §139 -18.A (Parking
Requirements - Enlargement of Building) . If granted, the Applicants
would be permitted to demolish the existing one -story retail
building located upon their premises, and to construct a new
building with the same ground cover and containing, in addition
to the existing first -floor use, second -story retail space and a
third -story apartment. The premises are situated at 4 INDIA
STREET (Assessor's Parcels 42.3.1 -167 and 204), Land Court Plan
14210 -N, Lot 1, and an unregistered parcel, and are zoned as
RESIDENTIAL - COMMERCIAL.
2. By our decision in Case No.008 -85 -, entered on February
19, 1985, and recorded with Nantucket Deeds in Book 226, Page
238, we granted relief to the Applicants for an identical application
and project to that before us in the present matter. Applicants
represent that, due to a misunderstanding as to the length of
time permitted for commencement of exercise of special permit
t' rights, the special permit granted in Case No. 008 -85 was
inadvertently allowed by them to lapse. Meanwhile, they further
represent that they have proceeded in good faith toward the exercise
of that special permit, and have expended considerable funds
toward architectural, engineering, and other design costs to that
end.
3. Under the circumstances of this application, and upon
the basis of the findings made in the Decision in Case No.
139 -81,A, which Decision is incorporated herein by reference, the
Board GRANTS the relief requested, by SPECIAL PERMIT, by UNANIMOUS
vote, subject to the following conditions:
(a) The third -floor apartment may be used only for
year -round occupancy, under terms and conditions identical to
those established for the occupancy of a year -round accessory
apartment under §139- 7.C(2)(g) of the By -Law.
(b) The proposed structure upon the premises shall be
constructed and used in full accordance with all terms, descriptions
and characterizations contained in the Board's Decision in Case
No. 008 -85, and in this Decision.
