OF APPEALS which has this day been filed with the Town
Clerk.
Any appeal from this action shall be made pursuant to
Section 17 of Chapter 40A of the General Laws, and shall
be -filed within twenty (20) days after this date.

DECISION:
The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, AUGUST
15, 1986 at 1:30 p.m. in the Town and County Building, Nantucket, made
the following Decision upon the Application of WALTER L. AND ANN P.
KAHN (083 -86) of 17 Meadow Lane, Nantucket, MA 02554.
1. Applicants seek relief by SPECIAL PERMIT
SECTION 139 -27J from their SECTION 139 -27F building
giving severe sickness as the unreasonable hardship
relief. The premises are located at 17 MEADOW LANE,
41- 406.1, Lot 3, Plan Book 21 at Page 76 and in the
zoning district.

2. Our findings are based upon the Application papers and testi-
mony;at our hearing given by Applicants. We are told that Mr. Kahn. was
stricken while abroad, survived by reason of excellent nedical treatment
there and, since, has undergone surgery, a lengthy hospital stay and
rehabilitative treatment here and in Boston. A written medical his:osy was
proferred. The statement by Dr. Lepore was received with the Application
papers.
3. We find that Applicants are obliged to relocate southward for
a climate more suited to Mr. Kahn's condition. The 5 -year covenant
entered by the Kahn's to obtain a building permit without "cap" delay
has now been observed for its full term, less 8 months still remaining.
Applicants are confronted by both personal and financial hardship of
the very sort set out in Section 139 -27J as a basis for relief.
4. No opposition was heard. Granting the requested relief would
be in proper keeping with our concern respecting precedents and in
harmony with the general purpose and intent of the zoning chapter and
(083 -86) -2-
specifically, the building "cap" provisions.
5. Accordingly, this Board by UNANIMOUS vote GRANTS to Applicants
the SPECIAL PERMIT under SECTION 139 -27J relieving them from their
building "cap" covenant (and barring their execution of another such
covenant).
