Sherman, Chairman BOARD OF APPEALS BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, AUGUST 15, 1986 at 1:30 p.m. in the Town and County Building, Nantucket, made the following Decision upon the Application of LEE MARTENSON (082 -86) of Box 2511, Nantucket, MA 02584. 1. Applicant seeks a SPECIAL PERMIT under Zoning By -Law SECTION 139 -7C to install an Accessory Apartment in her existing single - family residence. The premises are located at 95 OLD SOUTH ROAD, Assessor's Parcel 68 -162, Lot 140, Land Court Plan 16514 -Y and in the RESIDENTIAL -2 zoning district. 2. From the Application papers, it appears that Applicant is fully prepared to comply with each and every condition of Section 139 -7C. This Section is made applicable to the R -2 zoning district by Section 139- 8A(1). 3. Applicant's neighborhood is undergoing intensive development. Given her lot size of 93,000 SF with over 160 -foot frontage on Old South Road, addition of a second dwelling unit in the form of a year -round Accessory Apartment is both in harmony with, and favored by, our zoning code. Ample parking is available, as is area for septic system. 4. The Planning Board's recommendation was favorable, and no opposition was heard. 5. We find that the structure and use, as proposed, are in harmony with the general purposes and intent of the zoning chapter, conditioned upon full compliance with subsections 2(a) through 2(g) including execution of the 2(g) covenant and recording it against the deed to the property. (082 -86) -2- 6. Accordingly, by UNANIMOUS vote, this Board GRANTS to Applicant the requested SPECIAL PERMIT under SECTION 139 -7C for Accessory Apartment subject to such conditions.
