In the matter of the Application of WILLIAM M. DOUGHERTY and
MARY B. DOUGHERTY (079 -86), held at 1:30 P.M. on Friday, July 25,
1986, at the Town and County Building, Nantucket, the Board enters
the following Decision and makes the following findings:
1. This is an application for a VARIANCE granting relief
from Nantucket Code, §139 -16.A (Intensi.ty Regulations - Side Line
Setback) . If granted, the Applicants would be permitted to maintain
their existing dwelling, which lies within 4.3 feet of the side
line of their lot; 5 feet are required by the zoning by -law. The
premises consist of the property shown as Lot 24A on plan recorded
with Nantucket Deeds in Plan Book 21, Page 40 (Nantucket Assessor's
Parcel 42.4.1 -17), are located at 7 WILLARD STREET, and are zoned
as RESIDENTIAL -1.
2. Based upon the application and the materials and other
evidence presented at the public hearing, including the plan, a
copy of which is attahced hereto as Exhibit A ( the "Plan ") , the
Board finds that, in 1981, the Applicants constructed their single -
family dwelling upon the premises; through inadvertence, the
southeasterly side of the house was built within the required
5 -foot side line setback, ranging from 4.8 feet setback at the
southerly corner of the house to 4.3 feet at the easterly corner
of the deck. The Applicants, who have only recently learned of
this nonconformity, seek relief in order to render title to their
premises marketable.

3. This Board finds that, owing to circumstances relating
to the shape of the land and structures thereon (consisting of
the existing nonconformity in side line setback) which affect the
premises, but not affecting generally the zoning district in
which they are located, a literal enforcement of the provisions
of the by -law would involve substantial hardship to the Applicants
(consisting, again, of the existing nonconformity, and the fact
that, if relief were denied, the applicants would be prevented
from maintaining their existing structure which has been inexistence
for five years), and that desirable relief may be granted without
substantial detriment to the public good and without nullifying
or substantially derogating from the intent and purpose of the
by -law (in that no change in conditions now existing will occur).
The Board further finds, for the same reason, that the granting
of relief is in harmony with the general purpose and intent of
the Zoning Act and the Nantucket zoning by -law.
4. For the reasons set forth, the BOARD OF APPEALS hereby
GRANTS the Applicants relief from the zoning by -law, Nantucket
Code §139 -16.C, permitting the Applicants to maintain their existing
structure as shown upon the Plan, by a VARIANCE, by a UNANIMOUS
VOTE.
