BOARD OF APPEALS BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, JULY 259 1986 at 1:30 p.m. in the Town and County Building, Nantucket, made the following Decision upon the Application of ROBERT AND ELIZABETH READER (076 -86), address 20 Rich Valley Road, Wayland, MA 01778. 1. Applicants seek a SPECIAL PERMIT under Zoning By -Law SECTION 139- 9B(3)(g) to construct a motor vehicle storage, repair and service garage and to conduct such use in the RESIDENTIAL - COMMERCIAL -2 zoning district. The premises are located at 12 and 14 BOYNTON LANE, ASSESSOR'S PARCELS 67 -117.6 and 117.7 (respectively Lots 6 and 7 of Plan 17C) OFF THE SURFSIDE ROAD. 2. Our findings are based upon the Application papers, viewings and testimony, and exemplary restrictive deed (Lot 6), maps and plans made of record at our hearing. Such maps include the relevant portions of Assessor's Map 67 and of the Aquifer Recharge District, marked Exhibit A and B, Historic Dirstrict Commission Plan Set (Exhibit C), and parking plan (Exhibit D). 3. Couml for Applicants explained their interest to move from Weston, CT to Nantucket and to have here a foreign -car servicing business of quality comparable to their existing one. They propose a structure with two service bays (totalling 30'x32' =960 SF) opening toward Boynton Lane and a (24'x26' =624 SF) wing to the west containing office and ser- vice equipment area. A partial basement underlying the wing provides about 624 SF of storage. Applicants' apartment residence comprises the second floor reached by stairway at either end of the building. 4. Outside, two above - ground storage tanks will be installed meet- ing applicable regulation, said to have the approval of the Nantucket Fire Chief. One is for heating fuel oil, the other for waste liquids (076 -86) -2- to be drawn and properly disposed of by the fuel oil supplier. No diesel or gasoline will be supplied or sold from the premises. No substantial repair or servicing activities will be conducted outdoors. No motor vehicles (proscribed in Section 139 -20B) shall be stored outside for more than 30 days. With these stated conditions we find that Applicants' pro- posed use would not be in violation of Section 139 -20. 5. Off- street parking is proposed unit, 9 for about 1784 SF of service are 1 for storage area. The required loading stone surfacing is projected. The two lots (in common ownership, so merged for our purposess) will have their off - street perimeter screened by split -rail fence and vegatation of similar height (or by comparably appropriate screening) as a further condition for relief. 7. As the premises are some 180 feet outside the Aquifer Recharge District, we understand the Planning Board's recommendation to be favora- ble. Abutters heard from were favorable. Deed restrictions further ensure that the proposed structure and uses are in harmony with the general purpose and intent of the zoning chapter. 8. Accordingly, by UNANIMOUS vote this Board GRANTS to Applicants the requested SPECIAL PERMIT to construct and use the building per Exhibit C and parking as per Exhibit D, subject to the above - stated conditions. Vollans R t 6 BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 CONFIRMATORY DESICION: The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, DECEMBER 12, 1986 at 1:30 P.M. in the Town and County Building, Nantucket, MA made the following non - substantive modifications of its decision made on FRIDAY, JULY 25, 1986 upon the application of ROBERT AND ELIZABETH READER, of 20 Rich Valley Road, Wayland, MA 01778, thereby confirming its original intent and purpose: The last sentence of Paragraph 1 shall be amended to read as follows: "The premises are located at 12 and 14 Boynton Lane, Assessor's Parcels 67 -117.5 and 67 -117.3 (respectively Lots 5 and 6 on Plan 17C in the Nantucket Registry of Deeds) OFF THE SURFSIDE ROAD." By UNANIMOUS vote this Board corrects and confirms as stated above its decision on the Application of Robert and Elizabeth Reader made on Friday, July 25, 1986, filed with the Town Clerk on August 5, 1986, and recorded in Book 259, Page 159 in the Nantucket Registry of Deeds.
