Sherman, Chairman BOARD OF APPEALS Sir 61 IF BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, JULY 11, 1986 at 1:30 p.m. in the Town and County Building, Nantucket, made the following Decision upon the Application of EDWARD J. PIERING (074 -86) address 22 Hawthorne Lane, Nantucket, MA 02554. 1. Applicant seeks a VARIANCE from the setback requirements of Zoning By -Law SECTION 139 -16A and C. Such relief is sought to cure defects in siting an existing dwelling that violates front- and rear - yard setbacks. The premises are located at 22 HAWTHORNE LANE, Assessor's Parcel 056 -243 (Lot 17, Land Court Plan 14973F, Plan Book 37, Page 49, Certificate of Title 7098) and zoning,RESIDENTIAL -2. 2. Our findings are based upon the Application papers and testi- mony at our hearing. Applicant's lot is of an unusual generally tri- angular shape, with Applicant's single - family residence Sited very close to the only permissible zone where its footprint would be in conforming relation to the setbacks. We are told that the batter boards were set with care properly to ensure correct siting. Nonetheless, given the tightness of this narrow lot, the as -built plot plan dated February 11, 1986 for occupancy permit exposed the front- and rear - yard non - conformities. It shows the building front (north side) 28.75 feet and 29.99 feet from the lot line along Hawthorne Lane (30 feet is required) and southeast corner 9.33 feet from the rear lot line (10 feet required). 3. No opposition to the requested relief was heard. The Planning Board's recommendation was favorable. 4. We find that bringing the structure into literal conformity with the setback requirements would involve a substantial financial and practical hardship. The configuration of footprint relative to lot (074 -86) -2- shape assures that relief can be given without affecting generally the R -2 zoning district. Granting relief here is without substantial detriment to the public good and would not nullify or substantially derogate from the intent or purpose of the zoning chapter. 5.
